Grrrrrr!!!!! Ebay issue..what can I do?

Ordered two hair "cosmetic" items (to fill in thinning areas) as a buy it now on ebay. Received only one, with the package stamped "opened for inspection by USPS, and "Does not qualify for media mail" and "postage due 2.29". This auction had free shipping, so the shipping method was up to the seller. I contacted the seller, who claims he sent both my items in this package. I think he may be mistaken, because both the cosmetic and second set of applicators is missing from the package. Regardless, he contacted my post office, and told me they have no recollection and why would I accept an open package with items missing, and walk away without complaining. Ummmmmm...it was delivered to my house! Could've been his post office that inspected, but does it even matter? He is pretty much saying "post office lost it, tough luck". He said he spoke to ebay, paypal, and post office, and I am out of luck. I just filed a claim with ebay.
 
Did they use delivery confirmation? I am guessing not if they were used media mail. If they didn't, you will win a dispute automatically if they can't provide proof of delivery.

It's annoying to hear about sellers like that abusing media mail. I rarely use it because it is so slow, but it is nice to have as an option when I need it.
 
Did you get stuck paying the postage due?...I would be LIVID.

And - I'm thinking he is "lying out of both sides of his mouth". I'm of the impression that you don't talk to anyone at ebay and paypal, that all convo's are via e-mail.

There was a package with the one item delivered to my home. Seller is claiming I picked up at the post office and package was open. Tracking proves it was delivered. I told him that it was stamped "Opened for inspection by USPS", not that it was opened when I received, but I could see how that was misunderstood. Regardless, seller is slandering me now in th resolution center, in the case comments. Calling me a liar, that my story is changing. Unbelieveable! I have my original messages, so I have all proof.
 

No way should that have been sent media mail. The USPS is very specific as to what can go media mail and that in no way qualifies. So I'm not surprised it was opened and inspected.

If the seller printed the label through ebay, it would automatically have added delivery confirmation to the shipping label.

File a claim with Paypal immediately. They are very sympathetic to buyers.

File a "Not as Described" claim through Paypal. Paypal should instruct you to ship it back...use delivery confirmation when sending it back. Paypal will usually side with the buyer when they offer proof that you shipped it back.

I would also tell the seller that you will file a complaint with the USPS. His illegal use of Media Mail is what got the packaged opened to begin with. And when all is complete, don't forget the negative feedback for the seller. Sellers can no longer give buyers negative feedback.
 
If it was truly sent media mail and obviously didn't qualify, I would think you would have a case with PayPal. It is the seller's responsibility to get it to you, and it sounds like he was trying to save a buck by sending it media mail.

The tracking number will show what class shipping he used. eBay/Paypal can tell with that info.
 
Ebay can look into your messages from their end, and they will review them before making a decision. They want to know what the seller/buyer has done to resolve the problem on their own.

Have you paid the postage due yet? If you just received the item today. Tape it back up, with the original shipping label on it. Take the item back to the post office and refuse delivery of it, because you will not pay for the shipping charges. They will return the package to the seller. Make sure they mark in the computer system as "returned to sender" so the tracking information no longer shows "delivered".

Most the time, the mail man will drop an orange card in your box saying postage due on package, pick up at the post office. You take in the orange card, pay the difference and get the package. Although there's some delivery people that will leave the package, because they feel you're a good customer.


There's no doubt you'll win the case, and even if they deny it at first, just give ebay and call and explain what happened. Sometimes I wonder if they actually read the notes when filing a dispute.
 
Did you save the wrappping with the "postage due, opened for" etc. stampings on it? Make a photocopy of the wrapping if you have to send the original wrapping back. Many digital cameras will take closeup pictures of paper items suitiable for use as photocopies.

This will be evidence of enough irregularities on the part of the seller which in turn should improve your chances of winning the dispute.

Ordinarily you cannot "refuse" a package that you opened not in the presence of a postal employee. Meanwhile you can't verify that a shipment is short or defective until you open the package. I would hold on to the package at least until eBay tells you to send it back.

YOu can infer from the amount of the postage what class of shipment was used or attempted.

The problem with doing that is that the DC will show you refused it and you will lose any case you open in Ebay/PayPal. Refusing a package is grounds to void your buyer protections.

Go this route. Open the not as described claim. I had to do it on an item I won where the seller mailed the stuff in 2 packages. 1 arrived fine, the other, arrived ripped open and empty (be careful reusing boxes for heavy things, the USPS beats the snot out of boxes). Opened a case, the seller responded not her fault since the USPS did the damage and I didn't buy insurance (insurance is the responsibility of the seller, not the buyer FYI). I escalated the case and within 2 hours ebay found in my favor. They sent me a pre-paid shipping label and I sent back the items I did get. Very easy.
 
When you leave the negative feedback this seller deserves, no matter how this turns out, be sure and mention that the item was illegally sent media mail.
