Going through seperation what to do with dvc??

if Disney ROFR's the contract, does the Timeshare Store still get their commission?

Disney pays the seller the asking price. The reselling agent takes the commission out of the proceeds before a check is sent by the closing company to the seller.

Just to let you know an update on my situation. If we wanted to get out of the add on at BLT we could but my husband has decided that it may be in our best interest to keep it whether we stay together or not. He has said that we'll share the points being this was both our dream to own! So hears hoping that he sticks to it! Thanks for all your help and advice I truly appreciated it!

I don't mean to put my nose into your business, but I think this is a mistake. You can undo to the deal now for a very short window of time, and save yourself the possibility of much, much trouble down the road. If, after the dust settles, you two still decide that this is a good idea, you can do it then. This is NOT the time to make major, irreversible decisions, and the decision to keep it is that. The decision to get out of it is not irreversible.

I wish you much pixie dust at this difficult time.

Whatever you decide to do, the DVC account (both the assets and any debt) will have to be a part of your overall property settlement. In many cases, one asset has more value than another to one party and it's often possible to divide the assets in a way that is beneficial to both parties. To make that work, you really need to look at the whole picture...not one asset at a time.

I think the info you've received about +/- $55 per point repurchase is correct, and I also think there are several resorts that Disney would not repurchase for any price. I think they only repurchase in rare situations anyway -- I doubt it's anything they really want to do.

Given the uncertainly of your situation, I'd sure take a long, hard look at rescinding that add-on. No, it's not a huge deal, but it's $5,000.

Right now, you can get ALL of your money back -- later, probably not. And even in a best case situation, you would have to sell your points for less than Disney charges + pay a 10-12% commission. I'd sure consider cutting your potential losses whereever and however you can.

Good luck whatever you decide.

My exhusband and I went through this. We decided to sell because we couldn't come to terms with "sharing" for the next 40+ years. I am glad we did because even though we said we'd stay friends, the first girl he started dating didn't like it and we are no longer "friends". Good luck to you and whatever happens.
