I purchased my two contracts direct. If I gift my contracts, or will them to someone, will the new owners get the benefits of the direct purchase or will they be subject to the secondary market purchase rules?

Under those conditions, the new owner will still get direct benefits. The transaction will still need to go through ROFR and Member Accounting can provide the necessary information about doing that.

So if my kids inherit my contracts they have to go through ROFR? That doesn't sound right. If Disney claimed points from an inheritance that would be hitting below the belt!! And at what price would the points be taken as this wasn't a proposed sale?? I don't recall that language but, it was a long time ago(20 yrs) and there was a lot of legalese!

Every change in ownership must go through ROFR. For an inheritance, it's just a formality and I've never heard of DVD taking the points.
 

I transferred my contracts into a trust. I had to go through ROFR but it was just a formality.

In practice and I agree I've never heard of an exception but the only guaranteed option is to will them. There is no requirement that DVC allow gratuitous transfers of ownership and certainly not to allow the points to remain qualified. I don't expect any issues but there are some technicalities here that do add an element of risk. Plus it must be gratuitous, not simply cheap even currently.
