9. If you cancel your Booking

No allowance or refund can be made for any component of your Booking included in the price of your Booking but not taken, nor can any refund be made for loss, mislaid or destroyed tickets or hotel and/or ticket vouchers.

The above cancellation charges apply unless otherwise specified at the time of Booking. If a cancellation is made after we have sent tickets and final documents to you, no refund (if due) will be paid until all such tickets and documents have been returned to us or to your travel agent.

1. Your Contract
Walt Disney Travel Company is a trading name of The Walt Disney Company Limited. Your Contract is with The Walt Disney Company Limited whose registered office is at 3 Queen Caroline Street, Hammersmith, London W6 9PE. 'We ', 'our' and 'us' means The Walt Disney Company Limited. 'You' and 'your ' means the Lead Guest, as defined in Paragraph 19. These terms and conditions of booking and other Walt Disney Travel Company published information form the contract between you and us (the 'Contract'). All correspondence regarding this Contract should be sent to The Walt Disney Travel Company, 3 Queen Caroline Street, London W6 9PE. By acceptance of contract, 'You' as the Lead Guest confirms you are over 18 years of age at the time of travel.

2. Your financial protection
We are members of ABTA (no.W1803) the travel association. ABTA provides for your protection in the event of our insolvency.

3. Your Booking
When making a Booking, you accept responsibility for paying for all persons on the Booking and you agree to the terms and conditions of booking. On receipt of your Booking and the applicable payment, we will issue a Confirmation Notice to you. It is at this point that a valid Contract comes into existence between you and us.

Please check your Confirmation Notice and any other documentation carefully. We regret we cannot accept responsibility if you fail to notify us of any problem immediately. For Bookings arranged through a travel agent, all money paid to the agent will be held on our behalf from the time they receive it until they pay the money to us.

4. The price
Whilst we reserve the right to increase or decrease our prices at any time before you book, once your Booking is confirmed the price of your Booking as stated in the Confirmation Notice will not be increased, unless you subsequently amend the Booking.

5. Paying for your Booking
Theme Park Ticket only bookings must be paid in full at time of booking including accommodation, if you book more than eight weeks before departure, you must pay a deposit of £50 per person, which is payable at the time of Booking. The balance of the cost of your Booking becomes payable in full eight weeks before your departure. Payment may be made by visiting www.disneyworld.co.uk/payment or calling 0870 24 24 900. If you book within eight weeks of the intended departure date, then the total Booking price is payable in full at the time of Booking. For Bookings accepted less than ten days before departure, a charge of £10 per Booking will apply to cover additional costs to deliver Theme Park Tickets and hotel documentation. No further reminder of balance payment is sent to you by us. If the balance remains unpaid after the due date, we may cancel your Booking and you will have to pay the cancellation charges as set out in Paragraph 9.

6. Alterations by us
We will at all times endeavour to satisfy your requirements. When you have made your Contract with us, we will use our best endeavours to ensure that not one of the components of your Booking has to be altered. If a minor change is required we will, if practicable, inform you or your travel agent prior to departure, but we are not obliged to do so or to pay compensation. A minor change is any change apart from a major change, as defined below. When a major change occurs (i.e. a major change is a change to accommodation booked to a lower standard) you will be informed as soon as reasonably possible. You may then:

(a) accept the change; or

(b) make an alternative Booking with us for the original accomodation but on a different date. Where the price is less, we will refund, but where the price is more you will pay the difference. Or

(c) cancel your Booking and receive a refund of all monies paid.

In addition, in appropriate cases*, if you have booked a Hotel and Theme Park Ticket package or Hotel Accommodation we will pay compensation as follows, or higher if you can show greater loss:

In the case of reduced price or special offer Bookings, the compensation payable will be 50% of the above rates.

*An example of a situation in which the compensation above would not be appropriate is when we are forced to make a change because of a Force Majeure Event. For the purposes of your Contract with us, a Force Majeure Event is defined in Paragraph 7 below.

If you have booked a hotel and Theme Park Ticket package or hotel accommodation, and after your departure, we are obliged to make a major change to your arrangements, you will have the choice of receiving a pro-rata refund for the cost of the remainder of your Booking, or accepting alternative arrangements. In addition, if appropriate, we will pay you compensation of an amount which is reasonable taking into account all the circumstances. Disney's Hotel and Ticket package includes Theme Park Tickets which are issued on check in at your Disney Resort Hotel. If you wish to use your Disney Theme Park Tickets prior to arrival at your Hotel, you need to book Hotel Accommodation only booking and a separate Ticket only booking.

7. If we cancel your Booking
We try never to cancel a Guest's Booking, but must reserve the right to do so. In particular, we will cancel your Booking if you fail to make any payments by the due date. If we have to cancel for some reason we will inform you or your travel agent as soon as practicable. If the reason is for other than failure by you to make payments, we will offer you the choice of purchasing an alternative Booking from us (with you paying any difference if it is more expensive, or receiving a refund if it is cheaper) or receiving a full refund of all monies paid to us. In addition, if you have booked a hotel and Theme Park Ticket package or hotel accommodation we will pay you compensation as set out in the compensation table under Paragraph 6 except where the cancellation is made as a result of unusual and unforeseeable circumstances, a 'Force Majeure Event '. Circumstances amounting to a Force Majeure include any unusual and unforeseeable circumstance or event beyond our control which we, or the supplier of the service(s) in question could not, even with all due care, foresee or avoid such as, for example, government restrictions on travel, political unrest, war or threat of war, civil strife, natural or nuclear disaster, industrial dispute, epidemics and health risks, terrorist activity, adverse weather conditions, fire or any unavoidable event beyond our control or that of our suppliers.

8. If you change your Booking
If, after we have issued the Confirmation Notice, you wish to alter your Booking in any way, we will do all we can to make the necessary arrangements, provided we receive written confirmation of the change from the person who has made the Booking, or your travel agent, at least 14 days before departure. This should be received in writing to the registered office address or by email to wdtc-uk@disney.com. In these circumstances, an administrative fee of £25 for each amendment will be charged. Before we accept an amendment to a Booking, we shall advise you if there are any further charges to be paid. These charges shall be paid on confirmation of the amended Booking. The following terms and exceptions apply:

(i) No changes are allowed from a full price Booking to a special offer.

(ii) If a Booking is changed the price which applies at the time the change is made will apply.

(iii) If all names change on the Booking then cancellation charges may apply.

If the number of persons change, the price will be recalculated on the basis of the amended party size, subject to availability. If due to a cancellation the number of persons in a room reduces to one, a single supplement will apply and we reserve the right to pass on any additional costs. Other cancellation charges may apply (see Paragraph 9 below).

10. Liability
(i) Where you do not suffer death or personal injury, we accept liability should any part of your booking with us in the UK not be as described by us in writing and/or not be of a reasonable standard, and, subject to (iii), (iv) and (v) below, we will pay you compensation of an amount that could be reasonably and properly expected, taking into account all the relevant circumstances. Any sums received by you from our suppliers will be deducted from any sum paid to you as compensation by us.

(ii) Where you suffer death or personal injury as a result of an activity forming part of your Booking booked with us in the UK, we accept responsibility subject to (iii), (iv) and (v) below.

(iii) We accept liability in accordance with (i) and (ii) above and subject to (iv) and (v) below except where the cause of the failure in your Booking or any death or personal injury you may suffer is not due to any fault on our part or that of our agents or suppliers, and is your own fault or due to the actions of someone unconnected with your Booking or due to unusual or unforeseeable circumstances or events which neither we, nor our agents or suppliers could have anticipated or avoided even with the exercise of all due care, or in the case of a Force Majeure Event.

(iv) Where a claim (whether for personal injury or non-personal injury) arises out of loss or damage suffered during the course of air travel, rail travel, sea travel, road travel or hotel accommodation, our liability to you will be limited in accordance with the provisions of any relevant International Conventions, namely the Berne Convention 1961, the Athens Convention 1974, the Geneva Convention 1973 and the Paris Convention 1962 and the Warsaw Convention 1929 (as amended by EU Regulation 2027 on Air Carrier Liability). Copies of these Conventions are available on request.

(v) It should be noted that our acceptance of liability in (i), (ii), (iii) and (iv) above is conditional upon you assigning any rights that you may have against any of our suppliers which is in any way responsible for the failure of your Booking or any death or personal injury you may suffer. Such acceptance of liability is also subject to you following the procedures for the notification of complaints set out in the Paragraph below entitled 'If you have a complaint'.

If you have booked a hotel and Theme Park Ticket package or hotel accommodation we will give you what assistance we can if through some mishap you or members of your party suffer illness, personal injury or death during the period of the holiday, arising out of an activity which does not form part of the Booking. Additionally, if it is necessary for you, or any member of your party, to bring legal proceedings arising out of the mishap, we may, subject to our reasonable discretion and providing that you request it within 90 days of the occurrence of the mishap, meet the initial legal costs associated with such proceedings. This is limited to £5,000 per holiday, and you will have to repay it if you are able to make a successful claim on your insurance policy or against a third party.

11. If you have a complaint
If for some reason you are unhappy with any aspect of your Booking with us, we ask that you write to us, within 28 days of your return, at The Walt Disney Travel Company, 3 Queen Caroline Street, Hammersmith, London W6 9PE, quoting your Booking Reference Number and providing all other relevant information.

It is unlikely that you will have a complaint that cannot be settled amicably. However, disputes which cannot be settled amicably, may (if you so wish) be referred to arbitration under an independent scheme devised by the Association of British Travel Agents. The scheme is administered by the Chartered Institute of Arbitrators, and provides a simple and inexpensive method of arbitration on documents alone. The Scheme does not apply to claims for an amount greater than £5,000 per person. There is also a limit of £25,000 per Booking. Neither does it apply to claims which are solely or mainly in respect of physical injury or illness or the consequence of such injury or illness. If you elect to seek compensation under this scheme, written notice requesting arbitration must be made within nine months after the scheduled date of return from holiday. Full details of the scheme are available from the Association of British Travel Agents, 68-71 Newman Street, London W1P 4AH.

12. Accuracy of information
We reserve the right to change any prices, services or other particulars at any time before we enter into a Contract with you. If there is any change, we will notify you before you enter into such a Contract. Some hotels make a charge for certain facilities which will be payable locally. Where possible, we have highlighted these for your guidance. Charges for these facilities are not included in your Booking and are out of our direct control and could be subject to change.

13. Your behaviour
You must not behave in a way that may cause distress or annoyance to others. You must respect and conform with local laws and customs. If, in the opinion of ourselves, any accommodations manager or other person in authority, you are behaving in such a way as to cause danger, distress or annoyance to others or damage to property, your Booking may be terminated by either ourselves or the supplier concerned. In this situation, we will have no liability to you and will not be responsible for making any refunds, paying any compensation or meeting any costs or expenses you incur as a result. In addition, you must meet any expenses we incur as a result of your behaviour.

14. Special requests
If you have any special requests that do not automatically form part of your Booking please tell us when you confirm your Booking. We will try to meet your needs but cannot guarantee to do so.

15. Travel insurance
All our Guests are required to take out insurance suitable for their needs before travelling. We shall not be liable for any costs or losses through your failure to take out adequate insurance cover.

16. Health and travel documentation
It is your responsibility to have travel and health documents as necessary. If failure to obtain any such documents results in fines, surcharges or other financial penalty being imposed upon us we will require you to reimburse us. You must ensure, by consulting your own doctor if necessary, of specific health precautions deemed prudent for visiting the US, and the appropriate medication/inoculations complied with. We will not be liable to you for any illness or discomfort you suffer through failure to have required vaccinations or to follow medical advice. Please note that postal applications for a British passport take approximately four to five weeks. Also, different requirements are applicable to non-British citizens.

17. Law and Jurisdiction
Your Contract with us and any matters arising from it shall be construed in accordance with English law and will be subject to the exclusive jurisdiction of the Courts of England and Wales.

18. Data Protection Statement
Please be assured that we have measures in place to protect the personal booking information held by us. This information will be passed on to the principal and to the relevant suppliers of your travel arrangements. The information may also be provided to public authorities such as customs or immigration if required by them, or as required by law. Certain information may also be passed on to security or credit checking companies.

If you travel outside the European Economic Area, controls on data protection may not be as strong as the legal requirements in this country. We will only pass your information on to persons responsible for your travel arrangements. This applies to any sensitive information that you give to us such as details of any disabilities, or dietary/religious requirements. (If we cannot pass this information to the relevant suppliers, whether in the EEA or not, we will be unable to provide your booking. In making this booking, you consent to this information being passed on to the relevant persons.)

19. Definitions
'Booking' means the purchase of tickets and/or accommodation from us by a Lead Guest.

'Confirmation Notice' means an email (where the Booking is made over the internet) or invoice (where the booking is made over the telephone) sent to the Lead Guest setting out details of the Booking and payment details.

'Contract' means the contract between The Walt Disney Company Limited and the Lead Guest, more particularly described in Paragraph 1.

'Lead Guest' means any person who makes a Booking and concludes the Contract with us for themself and/or on behalf of other Guests.

'Guest(s)' means our customer(s).

'Tickets' means Walt Disney World Resort Theme Park Tickets booked with us.

Its such a good price and I was wondering what if we have to move it etc *** we cant get flights. what are the policies for this if booking with disney


I know, i am very tempted to book through WDW pay a deposit and hope and pray to god i can get flights on them dates when they become available. I am slightly worried about what happens if i can't get flights, would i be able to move my dates? or would i just have to cancel?
 
it's really a good price - i just priced the yacht club - and it keeps showing me that if i book now i'll get free dining..

the rate, including free dining is a really good rate for the yacht club.

does anyone know what the cancellation policy is?

i have to go find it before i actually book.

it is £50 per person deposit, final balance due 8 weeks before. I already have a booking at the Yacht Club and going to see if they add DDP on for free as when I made my booking I could not buy the DDP.

how did you find free dining for pop?
i thought it's only for moderates and deluxe...(counter only for mods and TS and counter for deluxe)

the same dates this year 1st sep virgin still have flights left at at a good price so I'm not worried on flights and if its just losing the deposit i may well book!!!

I cant wait till we get back from our wedding trip to book it so may book it today!
 
I changed dates with Disney and it was simple, did not even charge me an admin fee.(in the t&c it said changes cost £25)

I am going to phone tomorrow to see if they will add it to my booking, I hope they will as with the uncertainty of the exchange rate it will be nice knowing I have everything booked at a fixed price.
 
Yeah this is where I think my dbf will be tempted as we would be paying about 200 more than this years holiday but then when we add dining costs onto eveything it would be cheaper than what we have spent this year. BF says he will do but it depends how he likes it this year. I think the akl addition was due to be finished early next year or is that just the villas? Im also tempted by WL.

SSR and OKW are up with the deluxe free dining at 44% off and work out cheaper than CBR.
