Is there are place or maybe its common knowledge, where you can read what is considered a "material change" ?
I've only been able to find text about if the COA wish to change the color of the building etc nothing about rules or policies should would be considered material changes/alterations.
Material change refers to a major change to the POS and the product.
So, from my understanding it would apply to the declarations and other aspects of it.
One example might be that owners get at least a one month home resort.
Eliminating that would be something seen as a material change to the contract
Another example might be banking and borrowing. We see guaranteed that right but
DVC can adjust the specifics to meet supply and demand of owners.
What they can’t do is just stop it because it’s part of the POS.
IIRC, the change to the ground lease at OKW was a material change and why some owners took action so they couldn’t be charged for capital reserves, etc for time after 2042 if they decided not to accept it.
You can look up though any definition for a material change to a contract to get a more specific definition.
In the context of home resort rules and regulations, our contract gives DVC the right to set them as long as they include key things that the POS states they must include.
Things like the 11/7 month window, modifications, etc can all be changed or amended by DVC as long as they believe it’s the best for the membership.
It’s why the change from booking 11 months from check out to what we have now, 11 months from check in plus 7 isn’t a material change to the contract.
