Ebay Stress Update Added

Do you know if you will get any fees refunded if you take the laptop back?

If it is a scam he will already have an 'independent' person who will write up a nice fault report for him.

Personally, i'm quite risk averse (or chicken little depending on who you talk to!) I would offer him the £50 discount and just try to forget the whole thing. It's a terrible thing to go through, good luck with whatever you do.

But if they found in his favour, he would get a refund and have to send the laptop back, wouldn't he? Even if he has got an 'independent' person.

Also he is asking for £100, not £50 - I can't afford to lose that much.:sad2:
 
He can only do a chargeback, if he funds his Paypal with a credit card.

I would definately advise you to ask on the Ebay forums as there are several people who can advise how to go about this.:thumbsup2

Thanks Nikki. I took your advice and bombarded the boards with questions for those ebayers! He did pay with a credit card.

i buy and sell a lot on Eaby (rather used to) so know a fair bit.
personally i would refute his claim, if paypal finds in his favour all that would happen is he'd have to send the item back and youd refund him.
in no way would i offer a discount.

one thing i would check is Final value fee.
in a lot of cases you get this back if a sale goes wrong, however if the buyer refutes you may not get it back.

Thanks Nicky. If paypal find in my favour, I get the fvf and if they find in his favour, I lose the fvf? That sounds right. I am tempted to risk it as I really don't want to offer a 1/3 refund for bogus faults.
 
I would be wary about accepting it back as I remember seeing something on Watchdog where someone was sent a nasty letter by recorded delivery but *** there was 'trackable proof' they were forced to refund! :eek: They did get the police involved but not sure if anything came of it. I think I would either just give the partial refund (grudgingly but probably worth it to end the whole thing...) or I guess refute the claim though not sure if that'd just mean more stress in the long run by dragging it out.

Someone on the ebay forum said they also send a shell back - not the original laptop.

This is a complete pain.
 
Update:

I filed a claim against him and he immediately filed one against me too! Why didn't he just ask for a refund?

Thank you Elaine. I hate this sort of situation because I become obsessed and stressed very easily. I find it very difficult to get any perspective. I will worry about it until it is resolved.:sad2: I wish I wasn't like this.

:hug: I know how you feel, it's one of the reasons i stopped selling on ebay as i would always worry whether they received their parcel, tried to put in a claim etc. It just wasn't worth the stress.
 
Tbh Brigette, it's put me off selling on eBay too. I am really honest and would never sell anything I would not be happy to receive myself. As a seller, you have very little protection against unscrupulous buyers.
 
Sadly I have fallen out with EBay.
Ebay's new policies are ridiculous,the buyer holds the seller's feedback to ransom.
I had a bad experience selling a buggy,they paid via pay pal..a few weeks later I logged in to my pay pal account to see it was - in the £ section.I checked the Post office prior to make sure they'd had the buggy and they had but had signed for it in a stupid name!
When I checked they had paid via CC (Pay pal) and their CC had taken the money back! I emailed them and didn't hear anything until a few months later when they had an attack of guilty conscience they then sent a cheque (I didn't think it would be cash-able) but it was.
Also the new trick,selling things like ticket's etc things worth value send them special delivery in fact more a less anything,it seems many people are signing for the first class recorded and claiming back the money and it's causing a lot of unhappy sellers.:headache:

I have been taught an expensive lesson. Paypal is a joke - once they have your money (the fees) they don't want to know. Ebay is the same. They turn a blind eye to the fraudsters and have turned their backs on the small sellers.

When did the transaction take place? I personally would try and drag it past the 45 day point but I am not sure this will work now he has logged a dispute.

I am personally going through the same thing with a low value item. I basically sold a Brand New Top and sent it to the buyer recorded delivery.

It arrived the next day after payment and the buyer emailed me sying she thinks it is out of shape and she thinks it is not new, she said she kniws I have no refunds stated in my listing but she will just get start a Paypal Dispute and get her money back that way.

I offered her a replacement top or an exchange (I had bought a couple cheap to get some extra holiday spends) and she replied asking for my address to return. That was about 2 maybe 3 weeks ago now and I still dont have the top back.

I asked on the Ebay forum and the replies said that Paypal always side with the Buyer and refund the money. So basically a small seller offers a better refund policy than a high street store, they can keep the item to use, damage, replace or ruin and then request a refund on the 44th day. How is that fair to honest sellers?

It is disgusting. From now on, I will offer a full refund if anyone complains. I won't get into any dialogue about the item, as it's not worth the stress. I think your buyer had changed her mind about the top and decided she wanted a refund so fabricated a complaint. My buyer was after a massive discount. The buyer has all the power now. I try to remember that I have some lovely feedback from genuine buyers/sellers and just one really awful experience on eBay. I suppose most people are honest.

I think then you can contact Paypal and say the item is not in the condition you sent it in but I don't know what happens next.

I filed a dispute and he then filed one against me. According to the resolution centre paypal are investigating it. I'm pretty sure it will go in his favour from what I've read on the forums.

I've checked my special delivery receipt and the weight of the parcel is printed on there, so presumable he couldn't send me an empty box or a special delivery letter, then again, DH said he could fill a box full of old newspapers or something. It depresses me that people could be so nasty. My instincts told me there was something dodgy about him from the first email. I don't think the outcome would have been any different however I'd handled it.
