Ebay Problem w/ Not Receiving Items

I sell a real lot on ebay, but don't buy often. I've had too many bad expierences with buying. However, I just started buying a few items again. Of course it has to go wrong right away again.

I bought a pair of pants and a top- 2 separate auctions from the same seller. I paid 10 days ago. I emailed the seller last night just to touch base to see where my items were or if they shipped. She emailed back telling me the pants I bought were damaged and she didn't send the top because I bought it w/ discounted shipping so on and so forth. She claims she emailed me about this. I didn't receive one, when I've had no problems w/ her emails to pay or about this. Either way, she told me to pick something else out of her store at equivalent price. I don't want anything else. I told her I either wanted the top shipped ASAP and a refund for the pants- or just refund everything. Either way please do something now about it.

So, today I get a really nasty email from her. She tells me she is going to cancel my payment through paypal. Then she's going to file a non-paying bidder report w/ ebay so I get 2 strikes against me. What is with this???? How, is that possible. I paid her 10 days ago via paypal which she takes.

Also, I files a report w/ paypal first and now it won't let me file with ebay.

How would you handle this??? Any advice??
 
As a seller, I would have noticed any damages to pants before selling, if I did indeed notice after the sale had taken place I would have emailed you promptly and worked something out, I would have asked if there was another item you were interested in replacing the pants with, if not I would refund for the pants and honored the shipping rate. As a buyer and a seller this seems the most reasonable as it is not your fault the transaction is not complete.

Usually a discounted shipping rate is offered on the second item, why is she disputing the cost on the initial item??

I'm not sure why you can't report to ebay since you held up your end of the bargain, I would keep contacting ebay until you are able to resolve this.

I would rather have the positive feedback and lose a couple dollars any day of the week. It sounds like you are dealing with someone who is unreasonable, how was her feedback?
 
She has 15,000+ feedback w/ only a handful of negatives.

She is really nippy in her emails. Unfortunately, everytime I try to report this to ebay I get held up because they send me to paypal to start a claim.. I already filed w/ paypal and can't file again.

I have sold over 1000 things on ebay in the last year. Now, I know why I don't buy.....this is the 3rd out of 5th time I haven't received something. :guilty:

Save all your emails from her--so you can forward to Paypal or Ebay if the need arises. She is definitely in the wrong here.
 
I just started buying again (sell off and on)and I'm having problems too! I paid for a darth vader costume for my son on Sep 13. She said she was mailing it 1st class. No tracking provided. I haven't received it and contacted her twice with no reponse. I just filed a complaint through paypal. I need it by Sat as we're heading out Sun to DisneyWorld and will be attending the MNSSHP. BTW, she doesn't live near any area hit by the hurricanes. My other son's Anakin costume hasn't arrived, but paid a few days later, and I am thinking that one will be here by then. I will be ticked if I have to go out on Sat to go costume hunting!

Doesn't she think that you can leave her negative feedback as well? You can reply to her neg & be sure to keep her emails so that you can forward them all to ebay. It will be obvious to them what has happened. She is shooting herself in the foot! BTW, a neg doesn't count as 2 strikes against you, just one. If she refunds you thru paypal that doesn't do anything...except prove that you paid for the items that you won.
 
Thanks everyone. I'm not worried about the negatives. I have over 1000 feedback myself and my rating is 99.?%. I just wonder what she was thinking when she said she was going to cancel my payment then hit me w/ non-paying bidder strikes. I did keep all her email, especially since she clearly states this as her intention.
 
If i were you i would open a separate account for buying. This was if you do get negative they wont effect your rating as a seller. I have been a ebay member for over 6 years but i dont do a lot of selling or buying just sporadic stuff.



I dont know if i would give up on ebay there are some good sellers and great bargains out there.


I would always pay with paypal

Keep track of the dates. You dont want to miss out onthe 30 day mark for filing a paypal dispute.
 
Well she refunded my payment late last night. BUT-- this morning she went ahead and filed a non-paying bidder report. The ebay site is useless when it comes to getting info. I need help with figuring out how I'm supposed to show I did pay. I do have my paypal receipt-transaction. I also have her email. Unfortunately, the entire system is monitored by computers. Nobody really reads my response.

It's rare for a transaction to go wrong on eBay, but sometimes problems can occur. If you've got a problem with a transaction the Item Not Received or Significantly Not as Described Process can help you resolve it.


Use this process when:

You paid for an item but didn't receive it, or
You paid for and received an item, but it was significantly different from the item description.




The most effective way to resolve transaction problems is direct and open communication between buyers and sellers. Once you initiate this process you will be able to communicate directly with your seller on the eBay Web site in order to resolve your problem.


Before you initiate this process, please make sure you have:

Reviewed the item listing carefully.
Emailed and called your seller.
Ensured eBay has your correct contact information.
Checked your spam filter for missed emails.
 
I intially filed a report w/ paypal. After emailing this person and getting no where. I then tried to file a report w/ ebay, but because I had previously filed w/ paypal it wouldn't let me. I have an email into ebay about this.

I now have my money back because she decided to refund my payment. So, the money is no longer the issue.

I'm wondering how to "fight" her on the non-paying bidder strikes. I'd like to nip this now, rather than having to get the strikes against me, and then appealing it. I know I would win because I have her emails stating she was doing this. I have my paypal receipt, paid via her invoice. Then I have my refund. It just seems like it will be a lot to go through.

Here's something alot of buyers don't know. First--DON'T respond to the unpaid item dispute---once you respond--the seller will be able to give you both strikes she is threatening. If you don't respond--she has to wait 8 days before that can happen.

In the mean time--send a separate email to Ebay Customer Support and give them the transaction numbers and tell them the whole story. They will want the headers from the emails---and maybe even the transaction number from the Paypal payment you initially sent. They should respond within 24 hours.

I can't believe she did that to you!!!
 
File a complaint with Paypal today. Go to Paypal and click on Resolution Center and then click on file a claim. The seller has to ten days to produce proof the she has sent you the items that you paid for - if she cannot produce proof that she did they refund your money. I have had to do this a couple of times and I always get my money refunded. I hope this helps.

THE PLOT THICKENS! So I go to check my paypal account, and find that the person I bought the Anakin costume from (one of the bigtime sellers)has refunded my money, because they hadn't even mailed it yet(paid on the 18th and I contacted them yesterday to see when/how it was mailed, the auction said it should arrive 7-10 days). There is no response from the Darth Vader seller. So I didn't have any costumes for my boys. I ended up convincing my boys to be Captain Hook/Peter Pan for the party at DisneyWOrld. (my dd is TInkerbell). I ordered the complete costumes for less than $50 shipped and had them shipped to POP. I will buy them their Anakin/Darth Vader costumes when we get back for Halloween day and sell the other ones. Argh. This was nearly a nightmare.
Oh, and I'm sorry to hijack the thread-hope your problem turns out okay!
