eBay help needed...can I file a complaint with eBay??

Another seller stole the wording from my auction :mad: and since we are selling the same items it is very confusing! At first I thought I'd clicked on my own item....anyone aware of any eBay violations this covers??

btw, his user name is wdwmagic1!

and mine is kajunswty (naturally)

I am so frustrated :rolleyes2 I take alot of time coming up with my descriptions and for someone else to steal them...uuggghhh! so unfair :crazy2:
 
I dont know what the link is but if you go to "help" on the ebay main page and enter in something like another user stole my description or picture or something like that it may help you find the link..yes they definitley cannot do that
 
Yes, you can file a complaint with Ebay! I had someone steal the wording of an auction once--Ebay made them cancel their auction after I complained. Make sure you send Ebay the item # of both the auctions, and I would even copy and paste the wording from each auction in your email to Ebay.
 
thanks DianeV for the suggestion...I hadn't thought of that. I did find the complaint form and had to list all of his auctions because he used my wording on ALL of his listings. What nerve!

Anyway, I hope eBay checks into it quickly...I will be watching his listings to see if anything changes..thanks again :cheer2:

I just took another look at his listings and he is offering USPS Priority shipping and only charging $2.50....not smart :rolleyes:
 
Looks like it worked - his auctions are gone.
 
oh man, I was too excited that eBay took care of this but no his auctions are still active :(
 
Sorry - I looked at WDWMAGIC1 not WDWMAGIC1!
 
There are two different WDWMAGIC1 sellers. One has ! at the end of their name. Shipping is definately underestimated!
 
I'm not seeing the same wording except the part where it says "mickey's christmas party will be held" yadda yadda...

But isn't that from the official Disney website? Maybe I'm not looking at the right auctions, either that or they changed the wording.

UGH! I won't even consider buying from someone with such poor command of grammar. I understand its a visual trick but I still won't buy from them because it looks uneducated and disorganized.

It makes me think of spam, so I wouldn't buy from someone who uses tricks like that to try to get my attention.
 
To be honest with you, I don't think you'll get far with this complaint. I guess it all depends on what eBay considers a "substantial portion" of your listing.

I looked at both listings for the Stitch pin. While the other seller obviously liked your language and style for some of the info, there are plenty of substantial differences between the listings as well. The other seller had to write their own HTML code to create their listing, and yes...they did drop some of your language into their listing. However, I'm not sure that is enough to create a violation.

I really don't see what's wrong with one seller getting ideas for a listing from another listing that they think looks good. Sure, you can't copy and paste another person's entire listing. However, the info in the listing isn't copyrighted, and so long as it wasn't a straight copy and paste and the other seller wrote their own listing (as similar as it might be) I guess I don't see the problem.

Actually, he didn't describe the item at all...every word in his description comes from my listing. The exact wording comes from one of my listings that ended right before he started these. I haven't heard from eBay but I did contact the seller and told him how upset I was about this.

Getting ideas is one thing, but the font / coloring even spacing is exactly the same as in my listings. I may be wrong but I don't think this is right :(

oh, and a side note about my font use...I am a power seller so Yes, it does work :cool1:

I'm not sure that you can attribute your Power Seller status to your font use. I would think that if you listed the same amount of listings with proper grammer you would still be a Power Seller. I think it's more about the number of items you list that allows you to become a Power Seller. For instance, I would never become a Power Seller since I only list about 4 things a year so it wouldn't make a hill of beans on what font I used.

I also agree the with others - I skip auctions with bizarre fonts. It's way too confusing.
 
Actually, to become a power seller, you only need to sell $1000 a month..and for people who sell furniture, or something big, that can be one sale a month. I have a friend that sells something, that allows him to sell just 6 items a year and keep his PS status. My items are inexpensive, so I have to sell a lot to keep mine.

Since her font style wasn't what this thread was about, I avoided saying anything, but since it was brought up, I skip over auctions with hard to read titles and descriptions (funny colors, bad punctuation, etc)..and I find auctions with caps and non caps in the wrong places give me a headache. I personally think people's sales would be higher if they didn't do that...I've never understood why they do.

As far as the other person copying her..I do believe it was very close, if not almost exact, and that eBay will prob address that. The other person wasn't very smart for not changing it a bit. You may have to show an old auction to eBay to prove you had the wording first.

Be really careful about doing this. That seller has the right to forward your email to ebay and file a complaint against YOU for emailing him and claim harrassment. Sending an email such as this may be grounds for susupension.
