DVC T &C Personal Use - Only Thread to Discuss!

I’m perfectly happy to answer ‘yes’ to the question ‘is it personal use’.

My point was that I don’t see how an owner can be deemed to have agreed to the new rules verbally over the phone. Pretty sure that wouldn’t stand up IF DVC ever try to argue the point that owners have implicitly agreed to a limit on rental restrictions by agreeing the new June 2025 rules.

I have nothing to hide, I just don’t like the way this is being done. Why have they not issued an insert to the POS in the usual manner? Is the checkbox an attempt to get everyone owner to ‘vote’ on the new rules?
DVC needs to come out and define “personal use”. Just this board’s various takes alone show it’s not at all clear. People firing off about what they strongly take it to mean aren’t necessarily right, they are just strong in their view. Never a good idea to confuse your guests/customers.

I agree. They can keep their definition of frequent and regular close to their chest if they wish I guess since people have shown when DVC defines it, it is abused, but we need to know what personal use means.

Ducked out of the thread for a day due to a medical procedure. Came back and skimmed all the new pages. Glad to see everyone is still at the very same conclusion (confusion) as before and really nothing new is being added

Since I don’t commercially rent I’m not going to to worry about it, stay out of this thread and focus on finding a new BWV contract that I will personally use. I’m also going to email DVC and thank them for taking some sort of action against commercial renters.

Poly is going to be the new test of that theory... VGF most of the time seems to work just fine for 1 BR and 2 BR owners... despite the studio-heavy approach...

Frankly with the way the points charts are going, the market for larger units is becoming smaller and smaller... The initial buy-in becomes prohibitive for too many families trying to book a week in a 2 BR, so they say a studio should be just fine - after all we stay in a hotel room already.

To me the entire point of a timeshare is to have large accommodations unlike a hotel room. But again, the demographics of DVC have changed and the program has shifted. Obviously large accommodations are still important or the Island Tower wouldn't have been built. But studios are growing fast.

Ok, that’s a modest proposal. Let’s say they attack the big guys only and it stops 25% of the rentals. What then? Is that sufficient for you, or would you think it acceptable that they keep going down the line until a certain percentage is hit?

I can’t give you a number. I’m for stopping egregious abuse while keeping ownership rights.

What percentage of rentals do you think they should stop at? 100%?

How about no more than 25% of you points on average per year?

If you only rent every 4 years, you could rent 100% of your points.

Every other year renter? No more than 50%, etc.

And if someone sustains an injury or has an illness in the family they need a note from the doctor before they rent more? And if they don’t provide it we shut down their account?

Be careful what you wish for. You may not like the end result.

Yeah, I think as soon as you try to start putting numbers on anything it gets ugly quickly. I guess that’s why Disney left it intentionally undefined. I still think that taking down the heavy hitters and sending out letters to members that are pushing the boundaries would suffice.

I’d actually be cool with that. I don’t want to give up any legal rights that I already have to use the property however I chose… but in principle it works.

Just trying to somehow combine quantity and frequency. But it would not account for emergent situations.

So it turns out we have an example of a Wyndham C&D letter, posted in TUG just today.

Well some new info so I’m chiming in. (Probably need to stop alerts on the thread to hold true to my stay out of the thread declaration)

Do you happen to have Wyndham’s commercial use prohibition definition by chance?

Even Wyndham gave out a warning in this instance rather than just cancelling a reservation.

Interesting the reply in post 2 talked about personally checking in for at least half the reservations.

I’d have to dig for it. But like DVC’s it is essentially “We know it when we see it.”
Didn’t spend too much time googling I just kept finding club Wyndham web polices. But I did find this. Can’t say if what’s posted actually is the accurate policy. Poster said Wyndham said any renting outside of their renting platform is commercial.

This wasn’t a super helpful little search I went on since DVC doesn’t have such a renting platform. https://tugbbs.com/forums/threads/wyndham-commercial-use-prohibition.363871/

I knew I’d end up wasting more time on this issue. DVC and the DIS boards are so addicting!!
