DVC by Resale, the option to Buy it Now?

DVC by Resale has a Buy it Now option on their site, which seems kinda neat, but how realistic is it? I mean, if you were to click on it to "buy it now" is there any chance someone else could possibly already have it on "hold"?

I see no other site with that type option on it.
 
Probably no way to know unless you give it a try. My GUESS is that success/failure varies depending on the contract. If I were interested, I think I'd call them and try to do it over the phone - that way I'd avoid getting my hopes up waiting to find out if it was even a viable option. :teeth: YMMV.
 
I spoke with Shontell (dvcbyresale.com) on the phone before I bought my first contract. Basically, you can make a lower priced offer on a contract, but until it's signed, anyone can offer full price via that button and supercede your offer. The contract I wanted said "offer received" but it was actually a good deal at full price so I used "buy now" and closed the deal that way. I like it because it gives sellers who price fairly a good shot at a full price offer without it being tied up with negotiations.

Once you click it and fill in the form, you'll immediately get the contracts to sign and return with a deposit.
 

I bought one contract that way. As I recall, the listing changed to "sale pending" immediately.
 
Yes, I believe that simply means you agree to the price listed and don't want to negotiate/etc
 
Do you know if the option obligates the seller to accept the offer? It should, IMO, otherwise there isn't much incentive for the buyer. Of course the sale is still only pending, but I just mean in terms of price negotiations. Seems like a good idea. Ebay has had this forever, so why not here?

I don't think they are obligated EXCEPT that the owe the broker a full commission if they reject.

I'm not sure if it legally constitutes offer and acceptance, but it does seem like it should.

However, any seller could back out at any time and all you get is your money back. Sorry, I'm a little bitter today since I just got my refund from the wire I sent two full months ago.

Of course, but are you (or me, or any other buyer) going to use the court system to enforce it? Probably not, given the financial and emotional price.

When I sold a couple contracts the agreement was that if a full price offer was received then it was considered sold. If I had decided it wasn't enough I would have owed the commission on it. Essentially I had to price at what I was happy with and lower offers were up to me to decide on.
