I filed with paypal as well but they cancelled it because they said I couldn't have a claim open on both ebay and with them. That made me mad because how was I supposed to know that? I don't remember reading it anywhere, but oh well. Ebay is just not for me I suppose.

I had a bad experience with a woman who had an auction on e-bay, but a store that was not, but took google checkout. She was a "disney shopper" and never sent my items. Google said that they could not refund my money b/c too many claims had been made against her and that she had been removed from their services. I called my cc company and got my money. I submitted all my e-mail documentations and was refunded right away.
Since you have merchandise, albeit falsely advertised it might be a bit more difficult, but if you cannot get anywhere with e-bay and pay pal the cc company might be a good option to try.
