Does anybody know how overtime pay works on a holiday?

I didn't give any specific advise for her situation. I just stated MY situation. But, I did not work in CA. Both the states I worked in are RTW. I don't know why you quoted me. I don't need any advise on this situation. Maybe quote the OP so they have your googled info.
I quoted you so someone didn't take YOUR situation and think it applies to everyone. All I said was your situation is "company specific" which it is.

Are those exempt workers under FLSA? If they are not than it is certainly illegal under the OT provisions of the FLSA.

I work in a unionized hospital in NY. We work 12 hour shifts. Per our contract, we get daily OT for working over the 12 hours. We don’t get “regular” time & a half OT unless we work more than 80 hours in the 2 week pay period. So a full time worker normally works 72 hours per pay period. They can work an extra 8 hours without getting OT. Anything over that, they get OT. We are represented by a huge national union, they know what they’re doing. It isn’t illegal to pay OT based on the 2 week pay period.

Yes, it is. For non-exempt employees, federal law is OT for anything over 40 hours per week. Not bi-weekly.

Nurses generally are exempt though.

After 42 years, several of them as a union delegate, I know about my employment & OT. The same provisions apply to all extended shift employees. I’m confident one of the largest unions in the country and a multi hospital corporation are following the law.
 

Well, I got my answer. It's eight hours of pay regardless if you work that day or not, and every hour you do work that day is time and a half, even beyond 8 hours. So if I worked ten hours on Election Day, it'd be time and a half for all 10 hours plus 8 hours of holiday pay.

Considering overtime is about $30 right now, that's not too shabby.

Also, each of us is expected to hit a minimum of 70% picks per day on average, and my average for the month was 116% according to my quarterly assessment today. That's nice to know.
 
To read these comments and responses makes me appreciate and value a collective bargaining agreement even more. The rate of pay, overtime, health benefits, etc. Wow, how grateful I am.

Again, workers in retail are non-exempt and federal law requires OT on a 40 hour week, which is what the original poster was asking about.

Hospitals are exempt.

I’m curious how making Election Day a holiday will work. If the stores and distribution centers are open. Everyone gets a paid holiday and some time and a half for working plus the holiday. Sounds like a bad business decision to me.

Giving time off to vote if your shift doesn’t allow it otherwise makes sense. This not so much.
 
I know that, for a company-recognized holiday, you get paid time and a half for working on a holiday, but what about if your shift goes over eight hours on a holiday? Does it then automatically bump up to double time? Does it remain time and a half if you aren't already over 40 for the week?

Even my supervisor at Nordstrom didn't know when I asked about it. I'm scheduled to work a ten hour shift on Election Day.

Well it depends on company policy - lol Traditionally OT is paid out after 40 hours have been worked. Some companies pay OT by shift though. If you work past your allowed daily time then OT kicks in even if you have not met your 40 hours yet. Your company policy is what is going to drive how you are paid.

I don’t think you should get time off to go vote. Besides the 12 hours that the polls are open on Election Day, just about every state offers anywhere between 10-30 days of early voting. There is no excuse other than people just want free time off to go and vote.

I agree that very few people NEED time off to vote but at least in California it is the law to allow it IF the persons shift wouldn’t allow it otherwise.

The early voting was new this year for many states (at least for ours). Company's probably had in their policy that employees would get 'x' amount of time off to go vote.

I'd check with your employer as to how they handle working holidays. The only employer that I had who offered paid holiday overtime was the USFS. I was a seasonal and got paid extra for working Memorial Day, Labor Day, and Fourth of July. Plus received Sunday differential for working on Sundays.

These days the company I'm with has 9 paid holidays, but we get them off. Otherwise, the response would be, 'you're salary'. Although we do get 2 hours paid leave to vote on election days.

I think election day should be a forced shutdown National holiday to allow everyone to vote.

Your last statement, here in PA, an employer has to allow you to leave to vote if you couldn't otherwise because you are working when the polls are open. I am reading that is a State law and varies State to State.

Without a law, my place of employment works 7a to 7p shift (production workers) and many have over an hour drive, so they wouldn't be able to make it to their polling location before they close at 8 (some are closed at 7) if they are scheduled to work. I have never heard of any one leave work to go vote in the 25 years I've been there.

Wouldn't that be a case where the worker could file an absentee ballot (assuming no early voting)?

California has similar law. And I am sure for the exact situation you mentioned. Your normal working hours are 7 - 7 / 8 - 8 or you work outside of your polling district, etc.
