Do you have the 27th, 28th and Jan 3rd off?

I get December 24 for Christmas Day, December 27 for Boxing Day, December 31 for New Year's Day. Back to work on Jan. 3. My husband has Dec. 27 & 28 for Christmas Day and Boxing Day and Jan. 3 for New Year's Day. It's always confusing when Christmas falls on a weekend.

Except for the fact that you also get your usual 'weekend' days, whether or not they actually fall on a weekend. I can't speak for all provinces, but of the three I've worked in, employers are, by law, required to give employees 24 consective hours off in any 7 day period, as well as 48 consecutive hours off in any 14 day period. You'd be amazed how many people I've worked with that don't know that and only get a day off at a time.

Have you ever worked in PEI? I've never heard of this. I'm a teacher and it doesn't apply to me, but I have many friends and family who have other jobs and they rarely get 2 days off in a row. When I worked in a call centre, it was very rare for me to get 2 days off, and usually then only when I asked for it.

My husband and I both have the 27th, 28th and 3rd off (although we have booked extra vacation time around there).

The kids start school again on the 3rd so I am looking forward to the "free" adult only time :thumbsup2

I've never worked in PEI. I have family there though, and you made me curious, so I looked it up. According to the Employment Standards Act of PEI:

16. (1) An employer shall provide each employee, except those employees excluded by the regulations, with an unpaid rest period of at least twenty-four consecutive hours in every period of seven days and, whenever possible, that rest period shall include Sunday.

So, you're right, in PEI, the 48 hours thing doesn't apply. You can legally be made to work 6 days a week, every week. In fact, even if you work 8 hours a day, for 6 days, you don't even get overtime. That doesn't start until you work more than 48 hours in a week. PEI workers get the short end of the stick, don't they?

Also, I decided to recheck the laws for Newfoundland, since I was going off of what I've been told, I've never checked myself. Turns out NL law is the same as PEI in that employers are only required to give 24 hours off in any 7 day period. But, overtime here starts at 40 hours, so most (full-time) employers won't do a 6 day work week.

Not entirely true. Full time employees get a choice (this is mostly for reatil employees). You can either get a lieu day and still get paid for it (ie, you get 2 days off [they can be any 2 days near that holiday], but still get paid), or you can work, and get paid a Stat Day, in which case (as an example) you get paid 7 days, and work 5.

My husband works in the hospitality industry and he gets paid for the day plus time and a half for working. So yup retail and hospitality industrys are different.

Thanks Zife! I wouldn't have even known where to look. It was worth a thought for my friends and family in other positions. I'm assuming that little bit about Sundays being off will change now that we have Sunday shopping year round.

I wonder how many Islanders realize that it's different in other places? I know that when I worked in the call centre, they would schedule us to work up to 48 hours a week and then no more so they wouldn't have to pay OT. Nice, eh?

Is that if he works *on* Christmas Day (or other holiday)? Because this is the case for retail too (and my profession, but our rules are a lot like retail), but I was talking about having Christmas/Boxing Days off, and working the days around them. No time-and-a-half if you don't actually work *on* the stat dau in question.

If he gets time + 1/2 for the days around holidays, I need to change professions :-)
