do we have any rights--rental property next door

the house next to ours is owned by an Indian tribe that rents to their people

were having so many issues and don't know where to turn

we suspect its a drug house--some days theres a lot of traffic in and out

very noisy usually around 4 am were woken up to loud talking--sometimes fights--one night it was a drunk fest and someone threw a brick through their picture window--we called police the people on the other side called and the people next to us all called that one in

were working with the alderman and police to get this scum out of here --its to the point where our son doesn't want the grandkids over unless their here too--so no more overnights which makes us very sad

wed like to move but where we would want to go house prices are out of sight--its nothing for a house to get multiple offers with way over asking price were both 62 and semi retired--DH is a subsitude teacher and I'm pool at a hospital so neither of us have steady income and don't want a $100000 loan we haven't had a mortgage in years don't want to have to start now over some idiots

we don't know want our rights are or even if we have any--it seems its so hard to get people out even if their scum--they seem to have more rights then we do--and were the law abiding ones--

police have been here several times and it seems all they get is a talking too

the boyfriend of the girl upstairs got evicticed but shes already with another scumbag

that haven't been enough calls to make it a nunsense property but no one has said what happens after it gets this title

all in all our hands are tied until something drastic happens

just wondering if anyone has any thoughts on if we have any rights or anyother place to turn

Wife of a police officer here...

Two questions -

The first is whether the house is on tribal land (around here, tribes can have their own police).
The second is whether you have an HOA.

If the house is just considered part of your town with the same law enforcement, then what you're doing is unfortunately all you can do... continue calling in complaints of noise and domestic violence/vandalism etc.

If you have an HOA, you can reach out to them as well (sometimes they can be more strict than police!) but if you don't, not much you can do except being persistent. All states are different so it's hard to say how things would be handled where you are. Around here noise violations would just get warnings, but drugs and fighting/violence would likely get you arrested, especially if anyone had priors.

so I guess Ill keep calling--just yesterday we had another incident--the neighbor on the other side saw one of the morons using the front lawn as one big bathroom!!! and we live on a main street I told her I would have tried to get a pic and went to the police with it

but it turns out the police were called it seems they were harassing people that were walking by they were just talked to and I'm sure the morons were laughing when they left

it seems like they have more rights then we do oh well

Trust me, it's just as frustrating for the officers as it is for you. They get the same calls day after day about the same people but often there's nothing within the law that warrants them taking further action other than giving warnings or citations. Just be polite each time you call (and call the non-emergency number) and let them know what you're seeing and document what you can. Eventually the cops will arrive while they're in the middle of doing something that's an arrestable offense.

Start documenting everything - photos, videos, logs of activity, license plates if you can catch them. The more documentation you have, the better you'll be able to establish proof that something is going on. So every time they break city code or local ordinances, every time you call the cops, every time a car pulls up at 4am, you'll have a record.

sorry php258 I don't agree with your thinking--with all what they've done over there( and all the other happenings) to the fact my son wont let the grandkids over unless their here too--its effecting my live--that's where I draw the line

do what you want in your own house but when it effects other people lives some thing needs to be done

and yes we do have a log of all the calls to the police and emails to/from the alderman office--

and its not being negative when theres safety issues there

I’m thinking different living habits are not what’s happening here based on the orig post... they sound like Losers to me and I’m thankful I don’t live next to them to see urinating on the front lawn, violence and more ..to reduce my House value, lose my sleep, and have Police at my block weekly etc
To each his own.. if that’s a negative view, so be it.

Ehhh they don’t have a right to violate noise ordinances, urinate/flash their privates in public, or possess illegal drugs if OP’s suspicions are correct. I agree that the world needs more acceptance and tolerance, but we don’t need more acceptance and tolerance of rude and illegal behavior.

Would it be a totally crazy idea to try and contact the landlords? Maybe the "tribe" (we call them "bands" here) administration would at least listen to your concerns. Maybe they have some interest in controlling their own bad apples and protecting their reputation in the community. It would at least be worth a shot. We certainly did so when our next-door-neighbours rented out their place to tenants that turned out to be a nightmare.

A meeting with the neighbors? Eek I’d be hesitant of that. If they throw bricks through their own windows I’d be afraid what they might do to yours! I’m sure they already know their neighbors are complaining about them... no need to let them know exactly which ones, in my opinion at least!

The behaviour you describe sounds awful and no one would want to live near that. That said, you made a point in your OP of stating the home is owned by a tribe, in spite of already knowing that the home was not on tribal land, thus making that point totally irrelevant. Then again, you bring up the tribe name instead of just saying that the police have offered to set up a meeting with the owners of the property. You seem quite fixated in WHO owns the property, as much as on the behaviour itself--which causes me to question how much of the issue could also be linked to you viewing things trough a lens of what you expect from the tribe, versus just seeing them as normal people. I suggest you really look critically at your own reactions and words and make sure you are upset for the right reasons, an conveying those reasons and ONLY those to neighbors and police and the owners should you decide to meet with them. People are much more likely to take you seriously if your complaints do not sound as if they might have a racial bias wrapped up in them.
