Divorce and DVC contracts

Hello all -

I know there have been threads about this before...but I searched and haven't been able to find them.

What are my options regarding a jointly owned DVC contract during a divorce? In our case, it is uncontested and relatively amicable. We have already decided who is getting which assets, with DVC going to me. I suppose I need to call my guide, but I thought I'd check in with the experts first. ;)

[SIZE=+0]First, I'm sorry to hear the news. :( At least it's good that things are relatively amicable.

I believe you would need to contact DVC Membership Administration to get the right paperwork for having a new deed recorded. In situations like this, I'm pretty sure you still technically need to do ROFR, but DVC should automatically waive it. Then you would have to file a need deed with Orange County.

Of course all this assumes that you have already paid off your DVC mortgage (if you took one out). I'm not sure you can even change the names on the deed if the mortgage hasn't been paid off yet.[/SIZE]
 
1. You need to pay off the DVC mortage.
2 .You will need a right of first refusal letter from disney. Let them know the divorce decree states that you get DVC. ( I sent copy )
3. Get a Quit Claim Deed from Staples or Office Max that is legal for FL.
4. Send ROFR, The Florida Department of Revenue DR-219, and Quit claim deed to Orange County Comptroller, Along with applicable fees. They will advise you the cost over the phone based on number of pages you are sending.
5. Send change of membership letter and fee to DVC.

6. Continue to enjoy your DVC.

If you have any questions PM me and I can send you samples of all correspondence to Orange county and DVC.

No Matter what they say you don't need a FL attorney or any assistance from other paid professionals besides a public notory. You will have to spend a few hours making phone calls, faxing, writing, and mailing but it can be done.

My divorce lawyer took care of the entire process for me. I suppose I could have gone through the process myself, but it was very easy to have the lawyer take care of it. I can't remember the fees involved with DVC administration, but it did not cost much at all in lawyer fees. Good luck.

I'm glad you got the DVC. I bought mine AFTER the divorce...so it is mine, all mine!!! :rotfl:

Thank you, everyone, for all of the hugs, prayers and well wishes. It is a trying time, to be sure, but I am thankful that DH and I have been able to maintain a relatively good relationship throughout. Sometimes, I guess it is just time to move on.

Our DVC loan is paid off, so no worries there. It's nice to know that I can handle this myself...or the let the attorney handle it for me. I'm relatively good at court filing, etc...so it shouldn't be a problem.

Shan, I will still be in Metro Atlanta...not sure exactly where I will end up yet...probably Roswell or Alpharetta depending upon my job (I'm interviewing right now...every technology company is at Perimeter or Windward Parkway...anyone need a good tech writer? :teeth:).

Unfortunately, I just went through this, and it seemed to take forever. My lawyer handled it; and after my lawyer sent me the deeds, I thought everything was settled. Everytime I called MS my husband's name was still on the membership. I finally called Member Administration, and was told that my lawyer should have sent copies of the deeds to MA along with a check for $100. I decided to send the copies myself. I called again just to verify that I was doing everything correctly and was told that they no longer required the $100. :) This was two weeks ago. My lawyer got the ROFR and sent everything that needed to be sent to Orange County and got the deeds in my name. In retrospect I could have done it myself, but was in no condition to do it at the time. From the time of settlement to getting the membership in my name, it took over a year!

I got ROFR, Deed changed, and Membership name changed in about a month. You can change the deed with the county and the old owner could make reservations for themselves.
To speed up the process once you find our new documents are available online print them out and send them into MS to change you membership name. My new documents were available online about 2 or 3 weeks before I got my copies in the mail. Online documents are PDF copies of your original, you only need to send MS a copy not an original.
 
Hi Katie, When my x & i Separated, married 27 yrs, i got the DVC, i bot more pts, thru ****************, & she had all of the paperwork/deed changed for me along with the purchase of the new pts. was only a few hundred $$. After we separated, 1 bot 200 more pts. Up until a few months back, i thought that i would be going to Dis by myself or with a girlfriend or my kids-22 & 27. My dream was to meet a man to fall in love with that also loved Disney-well my new BF & I are off this Thurs for 5 days-no kids & no x's! He has never been to Fl or to Disney! He/we are so excited.
