I think the benches should be removed and a single line should be implemented. Since that will not happen, it is a free-for-all. If you chose to sit, you chose to have a questionable seat on the train. I personally never chose to sit even when the option is available to me because I would rather have a decent seat on the train. Don't get me wrong, I am not insensitive; I don't fill in all available space unless that looks like what everyone else is doing. I also can't fault someone for following the rules and filling in that space, which is why I stand at the gate even when a bench is available.
On a side note, I hate situations like this. This is the main reason I park in the Toy Story lot; the busses have a single queue and it is not the free-for-all that exists on the trams. I don't mind giving up a seat to anyone who needs it more then me (children, older individuals, and those with disabilities,) and I like not feeling guilty for having a seat when someone else doesn't. I always feel guilt about something in free-for-all situations. Guilt for being too aggressive, or not aggressive enough.
