Ouchies..

I had to help someone today that had his wallet stolen.

Basically, nothing can be done. I figured as much. complaint was filed, they called him on a recorded line and he said he'd leave me alone from here on out.. so if he doesn't, he can get jail time.
They suggested I go to Magistrate court and file for a restraining order (learned tonight someone filed one against him when he was in high school.) but I don't think I will. It won't do much good because if it's granted and he's good for the initial 30 day period I have to have a hearing and it probably wouldn't be extended. Nothing he says online can be used because it could be anyone.

The information about on-line may or may not be correct. If he admits to writing it or tells someone else that he wrote it. You can also file a civil suit for Libel. Always scares people when they get served with papers that they have to go to court and you are suing them for money. Do not think that a restraining order doesn't do any good. They have teeth if someone keeps violating and you keep reporting. I know its a frustrating process but if you are afraid then he needs to stop this behavior.

But doing stuff online isn't breaking the restraining order. And he doesn't drive, so the only time he approaches me is if I set myself up by going out in public.. which I don't anymore. I don't even go to parties anymore. The only time he has approached me lately has been when he waited in line at BK to talk to me awhile back.

I don't doubt he'd admit to writing it, but I really don't know if I'm up for it. Starting this new job and finishing at BK, I've slacked off in school and I've withdrawn from two courses and I'm failing another. Missed a midterm tonight to go file the complaint, because it totally left my mind that I had to finish the midterm by tonight. I e-mailed my professor so we'll see.. but still.

What is libel?
The Trooper said that he's undoubtedly commiting slander because he posts on his journal all sorts of things about me.. tells people things about me.. that are true only in his head, and make people mad at me for being such a witch with a b!
I guess all that IS illegal, if you could get him to admit he said it.

He said there really wasn't anything I could do beyond going to Magistrate.

I say--go back to what Malificent said, she's a lawyer!! and follow through on that, or else, withdraw from college, talk to Chase about a transfer to Florida, pack your car with your stuff and Rink and go find Erica. Leave no forwarding address with ANYONE!

Piecy,The long and the short of it. If you and this guy ever had a relationship - boyfriend/girlfriend partners anything you may be able to get a protective order. If not then there are anti-stalking laws and statutes in every state that should protect you. Run do not walk to the DA's office they should have a section that deals with domestic violence or stalking crimes talk to them and file for a protective order or restraining order. Please please please take the time to do this. If you do not know where to start call the operator and ask her for the phone number of the women's shelter in your area. They should have an attorney or at least social workers on staff who can direct you. This stuff is very serious and you should not fool around with it.

I really, really can't just take off... Besides, when I planned on moving before he planned on following me. Posted entries about it all the time.. how he was going to transfer to a movie theater down there because he couldn't stand to be that far away from me. Thats when i started telling people I planned to move to Alaska.

I am so sorry you have to put up with this, but the others are right. This is scary and you have got to take some action to take care of yourself and protect yourself. The idea of moving was supposed to be a joke and harder alternative than following Malificent's advice.

Doesn't seem like there is a whole lot to do.

Josh went with me.. he's actually the one who pressed me to go at all.. and he's going to try to get Dustin to vocalize something. The Trooper said that if Dustin even vocalized a threat through Josh, I could file a suit. So Josh is going to try to press around some this weekend. He planned on doing it anyway for his own peace of mind but now there is even more reason to do it. He thinks I should give it a couple weeks, see if the phone call from the State Police has made Dustin calm down any or not.. and then possibly take action from there.

I don't know why but having the print copy from the paper is different to me than just printing one offline. I guess I figured it'd of been more, though!)

He was a lawyer in Pittsburgh.. specialized in Family law and the such. I imagine he'd know a lot about stalking laws and protection orders and which way to go.. and of course, the best part-- he'd of been free!


I do appreciate what advice any of you offer-- especially maleficent.. (but if I get a bill in the mail.. I'm going to take the advice to flee the state with no forwarding addy! Oh, how I kid.. )

I do not know about Mike--he must have been discussed on pages I did not read. I have whole clumps of this thread that I did not read. Sorry for your loss.

We will see what Malificent and the others say today. Hang in there, keep a smile on your face, and keep documenting everything you can--past, present and future--are you keeping a log? If not, maybe today is the day to start one. In a loose leaf notebook so you can add pages when you think of things.

Disney Vacation Club to expand to Animal Kingdom Lodge

The Disney Vacation Club announced on October 11, 2006 that the Animal Kingdom Lodge would be the home of the next DVC resort at Walt Disney World. Rumors have been circulating for some time that the Contemporary was next on the list, but in recent weeks the focus had shifted to Animal Kingdom Lodge.

The first phase will be the opening of 134 remodeled existing rooms at the resort in late 2007. The next phase will be the opening of a new building containing 324 villas.

O.K. the long and the short of it - Slander is spoken words like if I said Jane Doe has cheated my business out of money or Jane Doe is a such and such she could sue me for slander. Libel is the written word. Of course you ask what about free speech can't he/she say whatever - a long story but basically no if it is not true and is hurting you. Truth is always a defense to libel or slander (remember what I am giving you is not legal advice but very basic ideas on the law.) (I am not licensed to practice law in your state) (that my dear is a legal disclaimer.) It sounds like you need to get some help. Again, I encourage you to call the local shelter they have counseling and all kinds of services they could offer you or at least point you in the right direction. Or call a law school in your area they may have a free legal clinic. My first year out of law school was spent doing domestic violence - again, not legal advice but seek out someone who can help you. Normal people do not make people afraid or uncomfortable.

More thoughts on the internet site. Even though he could say someone else is posting you might be able to send him a letter telling him he has awful things on his site about you and even if he has not posted them he has control of the site and has allowed another individual access therefore you would like him to remove or hold him responsible. Honestly don't know if it will fly but you might want to try it. Never hurts to send a certified letter telling him to stop this nonsense or your next step will be legal action etc etc.. Again, please contact a lawyer in your area as this is not legal advice, as I am not licensed to practice law in your jurisdiction (Hence the reason I can't send a bill even if I wanted to)

If I ever had to use it..
I could just see the security company calling us and asking us "Are you being robbed?" and of course we have to say 'NO' but then we'd have to go "But we do have a mentally challenged individual so you should put all the security stuff into place anyway!"

He's never really come near me other than a couple times when I was at BK. I avoid him when I go to the movies.
Well. I guess he did show up at my house on Valentines day, but thats it.
