Disney ROFR?

As seller, we just got ROFR notice on 150 BWV Oct YY, all 150 points coming Oct 06, none for Oct 05. Buyer offered $76pp and paid all closing costs and 06 dues.

I have a 200 point BVW contract that also sold a few weeks after the one above for just over $75 same YY and conditions as above. I'm assuming Disney will also exercise ROFR on it as well.

Is it possible for me to decide to NOT execute on Disney's offer then try to relist? I'm not sure if it's worth it for only a few more $$ per point.

I would doubt it since you are in a binding contract which you signed with the seller and with Disney. But you never know. The only mistake that I see in resales is that owners undervalue their ownership. I'm really not sure how the game works though. Do you set the selling price or does the broker say that they can get around $76pp for you ownership?? With Disney selling BWV at $92 pp, right now, owners that are going to sell should consider somewhere in the low $80s.

If I'm not mistaken, I believe the buyer can counteroffer. But, you may be obligated to continue with the sale if they don't.

Any else know for sure??
 

This is from The Timeshare Store website FAQs page (http://www.dvc-resales.com/faq.htm) addressing the question of whether a Buyer can come back with a counter offer:

IF DISNEY EXERCISES ROFR, CAN I COME BACK WITH A HIGHER BID?

No. Disney has advised us that once they have exercised their ROFR, the bidding process is over.
 
DVC in the past has sometimes allowed counteroffers, but it is within their rights under the contract wording to close immediately.
