Disney.com Terms of Use Updated 5/6/08

It was really hard to miss the BIG, BOLD, RED LETTERS at the bottom of the VMK Site that said that Disney's Terms of Use have been updated today.

It is my honest opinion that DIG would not post this on the VMK site unless it meant something for us. Now I don't have the previous Terms, but here are some that surprised me:

THE CONTENT ON OR OTHERWISE RELATED IN ANY WAY TO WDIG SITES OR ANY THIRD PARTY SITES OR SERVICES LINKED TO FROM ANY WDIG SITE IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ... AVAILABILITY ... AND NONINFRINGEMENT. WE DO NOT WARRANT THAT ... ACCESS THERETO WILL BE UNINTERRUPTED....

UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL WE, OUR LICENSORS OR LICENSEES, OR ANY OF THE FOREGOING ENTITIES' RESPECTIVE RESELLERS, DISTRIBUTORS, SERVICE PROVIDERS OR SUPPLIERS, BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ... THAT RESULT FROM (A) THE USE OF, OR THE INABILITY TO USE, ANY WDIG SITE OR CONTENT....

And what really bothered me:

WE MAY TERMINATE YOUR FURTHER ACCESS TO WDIG SITES OR CHANGE THE WDIG SITES OR DELETE CONTENT OR FEATURES IN ANY WAY, AT ANY TIME AND FOR ANY REASON OR NO REASON.

Just to give another perspective on this...

The updated Terms of Use is part of the footer that is put on the bottom of all www.disney.com pages, so it has nothing to do specifically with VMK.

The first two sections have been part of the Terms since at least 2001.

The line you bolded about "ANY TIME AND FOR ANY REASON OR NO REASON" has been part of the Terms of Use since the October 31st, 2006 update of the terms. If you didn’t agree to these terms then, (to quote the same document you quoted), “If you do not agree to these terms of use, you may not use the WDIG Site.”

I'm no lawyer, that's for sure... but I don't see any of this in response to something related to VMK.

It's nothing VMK specific, it's on every Disney web site. As for the "without reason," IF that's new, it's very standard wording for that type of disclaimer. It basically is saying, "we can do what we want, it's ours."

I ran sweepstakes for several years and the "legalese" on sweepstakes forms are very similar, especially the "we can change anything, anytime, for any reason (or no reason)" verbiage.

Good eye seeing it so soon, I guess their bolded, red text works well, huh? LOL

To me, it sounded like they are saying they can close VMK or any Disney site for any or no reason. Nice way to back up your stupidity, WDIG. I hate you.

While they do have the right to end things for any reason or no reason, WE still have the right to protest and write and ask them not to.

I figured they put it at all of the WDIG pages.
And while I read and agreed to these terms, I didn't key into things that didn't seem pertinent. Who would have thought VMK would close?

For anyone who is looking for some fun reading, this is NOT the most recent, but here's what was Terms of Use on 11/30/06

The very last sentence of section 7:
"WE MAY CHANGE THE WDIG SITES OR DELETE CONTENT OR FEATURES IN ANY WAY, AT ANY TIME AND FOR ANY REASON OR NO REASON"

very closely resembles what after 1.5 years of changes is now section 12:
"WE MAY TERMINATE YOUR FURTHER ACCESS TO WDIG SITES OR CHANGE THE WDIG SITES OR DELETE CONTENT OR FEATURES IN ANY WAY, AT ANY TIME AND FOR ANY REASON OR NO REASON."

Legal tweaking. (Yep, it's a technical word. )

I agree its some legal touch ups, but people dont pay lawyers to tweak things for no reason. Its quite possible they are doing it as a result of the ruckus we are causing

Well i definitely think the update is due to all the ruckus we are raising, and it makes sense that they would update the terms on all their websites, after all same thing is gonna happen when they just up and decide to pull the plug on toontown, club penguin or pirates right? It is just a way of trying to cover their proverbial #sses! Every move they make is making me more and more disallusioned with Disney in general. Go Universal Studios!!!!!
