I'm my DS's tax consultant (:rotfl: -- I'm definitely not an accountant) and am trying to figure out whether he was a Florida resident during his CP. Since Florida does not have an income tax, it would be a huge advantage to be a resident there since North Carolina has a pretty hefty one.

Anyone know the answer on this or be willing to share what they did?

Generally speaking, you have to change your driver's license to the new state and re register to vote. After someone changes that, then it's usually followed up with a change of insurance information etc... my guess is that he was probably considered a North Carolina resident, he would know if he changed!

My daughter did it last semester too and is actually still doing it and we are not considering her a FL resident - its like when you go away to college out of state. I think for tax purposes you would need to do the whole make yourself a legal resident of the state and he was not there long enough to qualify.

Hello,
My mom is a CPA and when I was down there even for over a year I still Filed with NYS. I think it goes by where your permanent Address is and what residency steps you have taken. When I move again I will become a resident of that state but for something short term it is just easier to not bother with all the paperwork. I hope this helps you out.
 

I just went through this (literally within the past 1/2 hour) making many phone calls to Florida and Maryland (my son, the CP, is a resident of MD). He's in the same boat as your son, having to pay hefty MD state taxes, as well as penalties and interest on what he owes. The person I spoke with in the FL tax office said the only way for him to declare residency in FL for 2007 would be if if he had changed his license to FL or registered to vote in FL. The Disney College Program needs to advise it's participants to pay quarterly taxes to their own states or to contact a tax advisor. We would have had him pay quarterly taxes if we had known and saved the penalties and interest.
