DD injured on splash mtn-update p16

The whole tone of the original closed thread changed when the OP and others cried lawyer and media. What had Disney truly done wrong at that point? Nothing, IMO. I am not a blind Disney supporter...far from it actually. I just don't think things add up. Won't be the first time or the last someone disagrees with my opinion on the DIS. Just the way it rolls around here. I've seen some of the supporters here rake others over the coals they didn't believe. It's all just a matter of perspective and what you're willing to swallow.
 
sorry to hear all this happened. and hope all is well now, go on with your trip and enjoy.

I myself have gotten hurt on disney property, and got taken out by ambulance several times. one time it was a drivers fault for not doing the safety belts right, I ended up with a shoulder in a sling. I did not even consider going for a lawyer, and I asked for nothing, they just got me to the MK by means of a private drive.

things happen on vacation, all the time, Disney is not out to get anyone, and I find them being responsible if it does. they did handle the medical bills.

I was the first to say lawyer. I suggested it to get someone's attention but I did say to try being nice first too. So apparently, the tone changed in the very beginning because I was about the 3rd poster.
By the way,I'm offended that no one has taken up my offer of the Kool Aid as there seem to be a lot of thirsty people on this thread. :rolleyes1
 

Need an update on this. To the OP. for Disney "Not doing anything," you learned a lot during your drive with the manager from the BWV back to your resort. It is all perception and I think that much was being done, perhaps not as quickly as you wished. How is your DSD and what have you found out about her injury? I think that many of us are concerned for all of you and would like to filled in on the details.
 
as the OP, here is an update now that we are home. We arrived home last night-sunday.

So far, all we have heard from is the claims office. A nice person has been calling my wife about the injury. She asks how my dsd is doing and whats going on. My dsd was in and out of the wheelchair a lot the last few days. If she was out of it, she was on crutches.

Her foot is still really in a lot of pain. She had trouble walking on it using the crutches. We feel it is a broken toe or two, and the only that can be done about that is to tape them together is what we are told. As we speak, my wife and dsd are at our own dr getting it checked out.

On weds., claims had told us they had a check for us for the medical bills and wanted to settle before we left. Thurs she left us a message about 11 am to check on dsd. When we tried to call back we got voicemail stating she had gone for the day and would be out friday as well. we left a message as to her condition anyways. We did try sat and sun but did not hear back.

This morning claims called to see whats up. My wife said she is going to take her to the dr this morning and told her about the rest of the week. A lot of times we were there she had to return to the room because she could not do it anymore and the pain pills made her tired as well.

claims said they would call back this afternoon to see what we found out. Im guessing the really only want to know if we need further treatment or what the diagnosis is. If no further treatment is needed, im guessing they will give us a settlement offer. if it is, im thinking they will wait until its done before settling.

In all the trips ive made, this is by far the worse one. I have gone 7 times in 7 years. I am a true disney fan, not in if for the money as some of you suggested. I just think they should have taken a little better care while we were there. This was her first time ever to go, and it was not magical at all for her.


UPDATE-Just got a call from my wife at dr. they definatly want to xray her foot again. they poked on her toe and she has no feeling on the bottom of her toe, only the top. they are also going to give her a tetnus shot because her nail pierced the skin when it was stuck. Dr. said that should have been done at the hospital. Im sure we wont know the results of the xray for a day or two.

Sorry to hear that DSD spent a lot of time in the room because of the pain and the medicine. Hopefully, the xrays do not show anything serious.

Don't cash any checks until you're sure you're happy with whatever settlement they offer, often cashing the check indicates you've acepted their settlement terms and you give up the right to sue in court (if you needed to in the future). Read any paperwork they send you and make sure you uderstand it, if it's full of legal-ease get a lawyer to review it, you don't want to give up any rights until you're happy with the outcome. I know you don't want to "take them to the cleaners" but if they are at fault, you are due compensation and you want to make sure you get what you are owed.

Thanks for the update. I was thinking about your DD, wondering how she was. I'm sorry she had to spend so much time resting. Although there's been a lot of chatter about Disney and their responsibility....how do you feel about the hospital?? Seems to me their treatment/attitude/behavior was horrible.
 
I agree - what hospital was it that treated your daughter. It seems like they were the ones to really drop the ball here...

Is your DSD being sent over to the hospital for x-rays? If so, that will take a little time to have the report sent back to her doctor. For possible ligiment damage or broken bones, we typically see an ortho doctor instead. They usually have the machines right in their office and can immediately tell you the results. If nothing shows up on the x-ray, you might want to consider an MRI. If it's ligiment damage or a hidden broken bone, it should show up on this test.
 
I am sorry your DD is still having such a hard time! Appreciate you coming back to let us know what was going on even with some of the heat you took here over this.

Good luck to DD and give her a hug for us.

I have heard over and over that the hospitals in Orlando are horrible, and the place to go if you get her is to Celebration. They give you very good care over there :goodvibes , and I believe they have a hospital. This is not first hand knowledge though, just what I have heard.

To the OP, so sorry about your SDS injury. It can put a damper on the vacation. Regardless of how it happened, if there is a bar in the front part of the vehicle (they took it apart so it can't be the handlebar), they need to see about sealing that off, and put a drain hole small enough so that a foot can't possibly fit through it.

I hope she recovers quickly, and then you can take her back and show her a real magical time :wizard: ! And tell her to be careful on stairs. I was on crutches when I was her age, took a header down the stairs (truth be told I was taking them too fast), and injured my other ankle :blush: . I couldn't walk on either for a week!
 
This was at the Celebration Hospital.

Also, Disney called today to check in with us. I told her about the dr visit yesterday and they are now sending out a medical release form so that they can get the bills from them and the medical records as well.

She said she would call us back on friday to see if we heard anything about the xray and go from there.
 
Well, that's just sad. And to send you out without checking the height on the crutches and showing her how to use them. I thought that was required.
Hope everything goes well with her, and she heals quickly. Let us know how it goes.

WoW! Thats awful that DSD is not doing much better. I hope she feels better soon. I am SHOCKED at your experience at Celebration. When DH got hurt at Blizzard Beach (totally husbands fault for walking into rocks without looking), anyway, I have been to differenct ER's during our lifetime and have never seen a hospital like Celebration. They didn't even get the insurance info. until DH was done. I felt like I was in a whole other place it was different from any experience we had had anywhere.
I'm sorry that DSD didn't have good experience there as well.
I am also in shock that they wouldn't have given her a tetnus shot right on the spot since the nail went into her foot. That seems like a big no no on their part.
Hope she gets better soon. She sure won't forget this trip anytime soon.
