Overcoming criminal inadmissibility

A. Convictions/offences outside Canada

If you were convicted of or committed a criminal offence outside Canada, you may overcome this criminal inadmissibility

  • by applying for rehabilitation, or
  • you may be deemed to have been rehabilitated if at least ten years have passed since you completed the sentence imposed upon you, or since you committed the offence, if the offence is one that would, in Canada, be an indictable offence punishable by a maximum term of imprisonment of less than ten years.

GO on the website and scroll down to Table 1 you should be able to find out if you are ok or deemed rehabilitated.

What kind of law is this....

I am so glad I stumbled across this thread. My DH had been arrested for a DUI 5 years ago but by sheer dumb luck they lost his paperwork so his driving record reads that he was convicted of reckless driving (which is a misdemeanor although in it is not listed as a criminal misdemeanor)

I am going to do some research to make sure this isn't an issue in Canada cause we are booked on the Alaska 2013 out of Vancouver.

My DH had a misdemeanor from 10 years ago that he thought had been expunged already. Well, apparently, the paperwork didn't get completed and 10 years later, he went to Canada a few months before our cruise and discovered that they wouldn't let him in the country. Luckily, it was early enough that he could get the expungement paperwork processed before our trip and everything was fine on our cruise, but that was with a misdemeanor. So, just because your DH's conviction was a misdemeanor doesn't mean that he's out of the clear. I'd definitely still look into it to make sure! :)

We want to go to Niagara Falls this year and I am willing to do the paperwork for it, having dealt with immigration for the last 5 years so my husband can be a US citizen. But I don't want to have to do it twice.

We've been back to Canada a couple of times and he does need to bring his letter saying that his conviction has been expunged, but he doesn't need to file any new paperwork each time.
