Credit card $1000 deposit credited back - bad sign?

We have an accepted offer of $23,000 for 203 point AKL with all 2020 points banked into 2021. We paid the $1,000 deposit via credit card and it was sent to ROFR on 2/15. About 2 weeks ago the title company called and introduced themselves so I took that as a good sign that we passed ROFR. But on 3/8 the $1,000 was credited back to our credit card.

I know what you're going to say "just ask Fidelity what's going on". But I'm kinda hoping until I hear otherwise we're still waiting on ROFR. The Fidelity email on the 2/15 said it can take 30-45 days to hear back from Disney and to please be patient so I'm being patient. But that $1,000 credit on the credit card just doesn't look good to me. But until I hear it's been taken I think there's still hope!

If they gave you your deposit back I’d say it is a sign that Disney exercised ROFR. Contact Fidelity or the title company. There really is no other reason for the deposit to come back.
 
Is it not odd that they automatically refund it? DVC release market said it was my choice incase I wanted to go for another try

Probably depends on the company used. When we tried resale we went with DVC Resale Market as well, and like you they did not automatically refund it. But, they also didn’t tell me when it was taken by Disney. It wasn’t until I contacted the title company about some documents we were expecting that I found out.
 

I had the same thing happen to me on a contract that was ROFR I got the text alert that I have set up for my CC that it was refunded by the title company (Mason). I was using fidelity too. I had had that deposit on file from two previous ROFR and would have left it in escrow to try for another BLT contract. I emailed my agent and sure enough it was bought by Disney. So I would say with 100% certainty that it was bought back but not communicated to you.
 
But until I hear it's been taken I think there's still hope!
I have this box with my cat in it. My wife has been telling telling me it’s probably dead since I hadn’t fed it or heard it move in some time. But since I haven’t opened the box, I am sure it’s still alive.

So I’m with you on this one. Wait for Fidelity. They’re great with communication.
