Contracts

Timesharing Today is a regular publication for timeshare owners and offers suggestions, ratings and advice of interest to those owning timeshares. They also offer a classified listing to sell timeshares.

If you should choose to use the services of a timeshare broker it's likely the need for a contract would be gone, since the broker would be filling that need during the sale.

We are going through a private owver and closing with timeshare services, inc. Should this be something that we, the buyer provide, or should it be the seller's responsibility?

We just found out that we need one today (only because I contacted the closing service and found out that nothing was submitted to ROFR).

Does it need to be that formal of a contract, or would a letter stating the specifics due?

IMO, it would be the seller's responsibility to submit the offer to DVC since there is no sale without the permission of the seller. If they are reluctant, I suppose you can have them sign a document outlining the sale and sign their acceptance of your offer. DVC will need to know the particulars of the sale- amount offered, any agreements of note , closing costs are to be paid by whom, annual fee payments, etc.. DVC then has 30 days to consider the offer and allow it to go thru or accept it themselves at the same terms.

There does not need to be any formal contract in this case - a letter signed by both parties should suffice . The seller can easily contact DVC Member Accounting for details of what they will require, but it should be fairly straightforward.

I think we are going to try the letter. If DVD wants something more formal then we'll pursue the other options mentioned.
