Finally got in touch with the sellers. Said they are having difficulty finding a second witness. If they couldn’t find someone by the end of the week the liaison was to help find someone…….that was 10 days ago……

My goodness, this is surely not encouraging any future purchases from an international seller. I haven’t heard from the broker, so reached out to title company on Monday and they said they had no updates. The seller had four owners listed, assuming maybe they are having difficulty getting an appt nailed down. Trying to be patient, but it’s difficult.

If I ever buy another contract, the first question will be the location of the seller and the number of people on the deed. That will drive my offer. Had I been aware of the challenges, I would have opted for a different contract. I am paying dues for this year and will loose 6 months of booking accessibility. My trips are in jeopardy as availability is drying up for the dates we had planned.

I'm an international owner and have bought and sold DVC contracts before and its not really a problem with witness' I got my two daughters to sign it before going to the local notary.

You might need to get a real witness if you take the cumbersome road and use the notary at a U.S embassy. But I've never used that. For my first contract sold I was on vaca in the states and I used a random bank as notary and they provided everything free of charge - great service.

For the rest I used a local notary in my own country and then afterwards went to get an apostille and sent everything to the title company. The local notary dont care if anyone else signed the document before coming as long as I didn't and they also dont care about the content that i'm signing, they only certify my signature.

I will be so bold to say as an international I can get my documents ready just as fast as any U.S seller, at least if we are talking days - hours not so much. When I've receive everything from the title company I can have everything ready in 2-3 week days (not counting weekends)

I assume notary rules differs from country to country but since your sellers are international they might be able to do the same as I did.

But as a recent seller in the U.S. I just wanted to mention that even for U.S. sellers, one of the documents requires 2 witnesses; one of them can be the notary but you still need to have a second person witness. That's not just an international requirement.

@Cyberc1978 had their daughters sign as witnesses before going to the notary. That's... an interesting way to do it. I assume the witnesses are supposed to watch you sign. If the notary also is supposed to watch you sign, the notary might have questions if the witness signatures are already filled in. I guess that would be based on whatever the notary rule is, and how the notary interprets it. But it seems like this approach could slow you down rather than speed things up.

Yeah normally I would say you are right - But since its between countries things might be different? Furthermore our Local notary public doesn't care about the content of the document and only certify me and my signature. I could have wrote "Jabba the hut" as a witness for all they care.

Since our local notary public is certifying me and the appostile is certifying the local notary public I think thats all that is required because I have id'ed myself to the notary at least for preventing fraud.

In the good old days, many years ago we also had to sign paper deeds and so on requiring witness' but now everything is done digitally with a personal special digital signature that all citizen have. That way we have eliminated the use of witness' maybe something that the U.S could learn from.

I wish our seller was as proactive as you! We have been told they were not responding to emails. 7-8 weeks since closing documents arrived, they have finally responded that they cannot find a witness. I have been told appts for the US Embassy for motorizations are 5-6 weeks out. Last year this contract was in jeopardy due to unpaid dues. We are approaching June when legal action begins if they did not pay the dues again. It seems to be very complicated when it is an international contract or multiple owners.

Our sellers are in Japan. They have to have motorization at the US embassy I am told. But one would think there is more than one person there that could assist in witnessing. I do not know if they even have an appt for the notary.

I’d be running away from that as fast as you can. Plenty of other contracts out there.

Wow, you have patience. I would've walked away. You would get you money back since I am sure you are way past the closing by date on your purchase agreement. There are plenty contracts out there with deals to be had.

13 days from passing ROFR to receiving closing docs. From what they originally told me, I was expecting it to be a week or two longer. Hopefully this is good news for everybody else using the same title company; maybe they're working through their backlog.
