Here's a snip from a 2005 article I found addressing (in)effective assistance of counsel.

In order to establish prejudice resulting from attorney error, the defendant "must show that there is a reasonable probability that, but for counsel's unprofessional errors, the result of the proceeding would have been different. A reasonable probability is a probability sufficient to undermine confidence in the outcome."253

It still boggles the mind that the "it's not my place to judge" juror made the cut. That is the very definition of being a juror. If you can't judge, go home. Why she was kept is beyond me. I am afraid she will be a problem. Too often, her sort wants proof beyond "any shadow of a doubt" and not beyond a reasonable doubt. Maybe she'll get some illness that requires hospitalization and an alternate can take her place........

The media (or cops) have misconstrued/twisted....this translates to "They don't believe what I tell them, the *%#$^*&^^."

And when she told the police she would lie, steal or do whatever it took to get Caylee back, you know they wanted to say, "We KNOW you will lie. Why don't you try telling the truth for a change?"

I half expect her to raise her fist in the air and swear, ala Scarlett O'Hara, "As God as my witness.....as God as my witness, I will find my daughter. If I have to lie, cheat, steal, kill, thrust my ****s out of my top at a hot body contest or sleep with every man in town.....as God as my witness, I will find my daughter and never misplace her again." Cue the music.

Back when Madeleine McCann went missing, I was part of a BB (we were eventually shut down :rolleyes1) who were all over that case. At some point, a mole joined us. A Portuguese mole. It's been a while, so I can't remember if I thought this person must have connections with the police, the media or both. I swear; they would say, "No, X is not going to happen. I know it looks that way and all the stories hint at that, but here is what is really going to happen and it will occur in 2-3 days." Or it might be 12 hours, or one week or whatever. Sometimes what the person said was something no one saw coming. But they were always right, as to what would happen and when it would happen.

I miss that mole.....

I could not agree more. I really have a feeling she will be an issue and this will be a hung jury. :sad2:

JB said the Prosecutors wanted to dismiss that juror becuase she was black. Judge 'agreed' so they HAD to keep her. There was no way to get rid of her after that.
 
I'll be the mole, I need something to do this summer. :) The only problem is finances. I can't see DH letting me empty our savings so I can stay in Florida and play Super Spy. :lmao:

IMHO, that in itself is a racist way of looking at it. Would a White, Hispanic or Asian woman or man have been struck for being unwilling to judge a defendant? I am quite certain there are plenty of African Americans out there who are comfortable judging others, even if they are religious. It has nothing to do with race and everything to do with your job as a juror. She should have been GONE.

As for being God's place to judge......Well, He's not on the jury, is he? So we have to improvise, sister. Fish or cut bait. Judge or walk away.
 
Ok so I am late to today's proceedings and I am just watching the video with Cindy, George and CA where she asks George to stand up and model the new Caylee t-shirts.
How how how can the defense stand up and make those allegations about George molesting CA? CA has thanked him over and over again for being the best dad and the best grandfather.
And how how how can CA say over and over again that she knows Caylee will be coming home and everyone will be together and she will be the most over protective mom YET that baby is dead. OMG.

Yeah, 'cause I know when I searching for a toddler, I race to bars, nightclubs and men's bedrooms. The little rugrats ALWAYS turn up there. And as for being a shot girl? Everyone knows a toddler thinks shots are sippy cups! DUH!

I would say that I don't tend to judge people. But, I don't feel I would have any trouble convicting a person of muder under the law.

This is boring part introducing evidence. TV talk that this is opposite of the usual flow in a trial as usually evidence comes first. Expect decomp science to be questioned as junk science.

The stain will be admitted!
 
The Andrea Yates case is the only one in which I thought she should not be found guilty, but instead placed in a mental institution. What I truly believed is that her DH should have been the one in prison.

If you ever looked at the progression of photos of her, from her teen and young adult years to the time she killed her children, it was heartbreaking. She was a pretty, healthy, happy, cheerful looking woman who by all accounts was full of life and loving and giving. Devoted to her kids. As the years passed, and with each pregnancy, she got worse and worse. She became gaunt and literally a shadow of her former self. Any spark that had ever been in her eyes was gone and she just wasn't "there." Her mind was gone.

If you have ever, even once, been around a truly psychotic person, they will scare the beejesus out of you because when you look in their eyes, you realize they just aren't in the same world as us. It's frightening and pitiful at the same time, especially if you know that person USED to be completely normal.

When she had the 4th child and went from postpartum depression to full blown psychosis, the doctors told her and her DH in no uncertain terms that she should never have a baby again. That she would become psychotic again and it might be even worse. Any decent, loving DH would have run to the doctor and gotten snipped. But nooooooo, he just had to have another kid. She was in no shape to make an informed decision. Someone (her DH) needed to think and act for both of them and protect her physical and mental health.........and now we know, by extension, that of the children. He failed miserably. Why have one more child, knowing your wife will become psychotic? They already had 4 beautiful, healthy children and she needed help, not another baby and the psychosis it would bring.

By all accounts, any time she starts to make any progress, she realizes the full impact of what she had done and it sets her back again. It's a vicious cycle. If she's medicated enough to make her well enough, she is overcome by what she's done and has to deal with it over and over again. She will be in hell forever. Meanwhile, he's gone on, remarried and started a new family. :headache:

I agree completely. I've heard some of his reasoning for why things played out like they did, and he made me sick. He was a sorry excuse for a husband, IMHO.
