Okay I hope I don't make this too confusing.
On July 11, 2006 I was stopped at a stop sign pulling out of a store. I was waiting for some cars to pass so I could go. All of a sudden I got bumped from behind. It was so quick I almost didn't even realize it. I had my son in the back seat in his car seat and my boyfriends mother was in the passanger seat. I looked at her and said "Did I just get hit?" I have never been in an accident before.
So I get out of the car and this guy suddenly starts yelling at me saying "it's nothing, it's nothing." Okay....well I didn't have any dents, but I did have quite a few big scratches on my bumper. Normally I wouldn't care but I am going to be selling my car in the next few months. So I said, "well there ARE scratches on it." And he pipes in again saying "I'll give you $100 right now and be done with it." My boyfriend is good friends with a machanic and I know that $100 would probably just cover the labor. I refuse the money only to have him start yelling at me again saying "Just take it. It's cash in your pocket." I wanted to cry only because he was being so mean.
I asked him if I could please get his insurance information and he refused to give it to me. Now I was getting frustrated. So I asked again. He said that I didn't need his information. At that point my boyfriends mom said she was going to call the cops if he didn't give it to me. His response to that was " Fine. Call the cops. I'll say she backed up into me. I'll say that the kid wasn't in a car seat." Now I'm fumming mad. Do NOT bring my child into this. He WAS in a car seat and I would NEVER drive anywhere with him not in one.
So in a snotty voice this guys says "Gee, too bad no one has a camera to take pictures of the damage. Oh wait. I do" Just real smug. And he whips out his camera phone and starts snaping away. Well I don't have a camera phone, but I do keep a disposable camera in my glove box just in case something like this should happen. He looked a little surprised that I brought a camera out. And I took some pictures too. Just incase.
So I am asking for his insurance information again and he finally gives it to me. I give him my information also. He then states "Well if my insurance pays for this I'm switching" He really sounded like he did NOT want to go through his insurance. And I was fine with that. I really don't care how I get paid for the damage. I just want it fixed.
I went the very next morning to the local auto body shop and got an estimate. It totalled to $379. I faxed him a copy of it. He was very nice but said he wasn't going to pay that. Then he emailed me again saying he wants me to go to a particular place to get another estimate.
I'm just so frustrated.
Should I just call my insurance company and have them deal with him? I don't mind going to get another estimate, but this guy just has been dragging this out as long as he possibly can. It's been a little over a month now.
Any suggestions would be greatly appreciated.
