Hi there!
I am really excited to buy into the DVC.. I have a friend who has a friend that is going through a sticky divorce. They are DVC members and are looking to see their points.
Can they sell them directly to me? Or is there small print in the contract that says you cant just sell it to a friend whenever you want to..
Can anyone help me out??
Thanks!

If I remeber correctly since its a deeded property it must be sold and closed thru a closing agency. But you do not have to have a agent involved. Disney also has a first right of purchase and must approve all sales before they can be completed. Which means if the seller is asking too low of a price then Disney can just buy the property back at that price and you will be out. So I would suggest you follow the rules and pay as close to the going rate as you can or you'll both loose out.

Do you think $75 a point is way too low?
How would I find out what's reasonable?
Thanks!

You need more information: How many points? What resort? Are there any banked points or current points? Knowing the resort you'll know the popularity, the maintenance fees and when the lease expires.

$75 would be pretty low for most resorts but might pass for Vero Beach which has a higher MFs.

The sponsor of this Board has a resale board which you can check out and get a sense of the market. Also check out the "Anyone recently passed ROFR" thread on this Board. (Go to the end of the thread) There's a list of who passed ROFR and who didn't.

Good luck. Amy

There's no special process for a friend. You need a $$$ amount and contract and submit for ROFR. DVC may take it if you put too low an amount. BTW, it's illegal to put one price and actually charge another. So you can't legally jack up the price on paper with an agreement to settle or rebate to end up at a lower price. DVC can give you the info how to do so. You do not have to use a closing company but may want to.
