Called about buying VGF direct and only Feb use year for sale

The only sticking point I see here is that in option #2 ... what triggered the $3,300 rebate? It wasn't a true rebate (free money) ... there was an exchange (transaction). I gave them something, and they gave me something. If the integrity of the contract must remain whole, then I allowed them to use something that I owned in exchange for money ... I rented it.

Having the points in your account as soon as they send you the contract doesn't mean anything. You can act like you are the owner and even make reservations, but if you tell them in writing on day #9 that you changed your mind, they will cancel all your reservations, the points will disappear, and you will get a full refund. It will be as if the whole thing never happened. It would not be as if you purchased ownership and sold it back to DVC at the same price which, if you could even do that, would trigger tax reporting of a real estate transaction (with zero gain or loss).

So, when they took "your" first-year 150 points you actually didn't give them anything that was yours because you don't own anything until the deed is filed in Orange County. You simply agreed to give up use of your first year in exchange for a lower purchase price, and by the time the deed is filed they make sure you have what you bought (in my case, the first-year 150 points were gone less than 36 hours after receiving the contract, and even before DVC signed the contract). The fact that the "lower purchase price" is materialized in the form of a rebate check from the developer is immaterial.

Let's wait until January to see if you get a 1099... I wouldn't hold my breath.

I agree (I didn't take into consideration that, until the closing, I owned nothing) If I didn't own them when they took them, I can see a strong argument for a rebate.... we won't know until we see if we get the 1099. And honestly unless someone is buying thousands of points, is it really going to matter.

Say you want a week 1 favorite week standard view resort studio topped off to 150 points and I doubt DVC will want to sell you a February UY :rotfl:

In all seriousness just push back for the 2, 75 point contracts in Oct or say you don't want the points. I am sure it will be done no problem. "Magical Beginnings" isn't included, but that's the $22 buy back per point if you purchase 150+ points. That isn't taken off the initial price. You pay for it, then you are sent a check for the buy back after closing. It would work extremely well with an Oct UY since you are forfeiting 2022 points (only 3 months left in the UY) with your full allotment coming 10/1/23. I have a feeling this is why it isn't the preferred sale choice.

Or is that the additional incentive MB?

The UY and 100/50 split is very strange...

The 2,500 vs 1,500 developer credit looks like the difference between a current member add-on (my link) and new member purchase (your link). However, it seems like the "Welcome Home" incentive is missing for adding on during a trip or having a trip scheduled. I believe that is 1,000 for new members and 1,500 for current members. New members are eligible for the "Dream it Forward" referral (another thread here on the DIS). That would be another $500 and make the difference between current and new members a total of 1,000 before Magical Beginnings.

Magical Beginnings is 22 per point and comes as a rebate check after the sale. It would not be factored into the initial pricing. You pay for the points, give the current UY back, and DVC pays you $3,300 (on 150 points). If you want to participate, just subtract the 22 from whatever the final sale price is after incentives to see your number (I believe it's mid to high 160s for new members).

I agree with @crvetter ask to speak with your guide's supervisor personally about the UY and splitting 100 and 50 points. Then go into the missing incentives and find a "Dream it Forward" here on the DIS from the referral thread. Don't take a UY or contract size you don't want. There are other threads floating around where people are getting a lot of misinformation from guides. It's very sad how inconsistent it all is.

I would simply let them know you are disappointed and that you would like to talk to someone else since you know if others who had no trouble getting a UY that works.

You can then say that if they can make it all happen, you will buy and to contact you when he can get the approval needed for an Oct UY.
 
I'm glad I saw this forum. I just joined yesterday and asked my guide for a different use year and he said the only one they had was February. But I'm going to push for a December Use Year. I haven't even finished signing the documents yet.
