Hi,

I have a DVC member interested in selling us her points. We are not current members, but would like to complete the transaction without a broker- is that possible?

You don't need a broker, but you do need to submit to Disney for ROFR. You'll need to have the deed drawn up, so you'll probably want to use a title company.

There's no real benefit to a buyer to avoid a broker.
 
Unless you live in Florida, I would use a broker. Even then, probably so. In Florida, you can probably find a lawyer who can handle the transaction, I'm just not sure it'd be cheaper than paying a broker a commission.

I doubt many attorneys in other states can legally transact a property deal in a different state, but I'm not an attorney. Even if they could, it wouldn't be cheap.

I would not try to handle a deal on my own unless I knew what I was doing. DVC is a niche transaction. Ideally, you want someone with lots of experience doing just those kinds of transactions.

I would call the Timeshare Store (Disboards sponsor) and (not sure if I can mention them here) - Magic Vacation Title and ask about it. Maybe they'll cut you a break because they aren't actually marketing the property.

If I were the seller, I'd try to keep the transaction fees, for sure. If I was buyer, I'd want the protections of a deal done right. You're the buyer. I'd use a broker if I were you.

No matter what you do unless it passes thru ROFR the deal will not go .Disney get's the last say so make sure it's a reasonable transation
