British Girl Sues Disney...

Maybe i'm missing something here, but how would restraints prevent a heart attack:confused3

Whilst I feel for the girl I can't see how she would win this case as the ride was operating normally & thousands have used it no problem. If the ride design was at fault many would have suffered.

Only had a quick read but 3 years after? only £10,000? rode it several times if it wasn't safe?
Something doesn't add up with the story. Maybe its genuine but not right to me.

Thats exactly what i'm thinking there are too many holes in the story.

I remember this story and, whilst I feel for the girl and her family, I thought Disney had been found blameless at the time. I also thought the conclusion was that the girl might have been predisposed to a heart condition... I'm puzzled why they've waited until now to sue. Compensation-wise they are vague as it says £10k+ so could mean anything... I wonder if a law company has approached them (and possibly others) as the legal issue they're raising is obscure but could apply to many... :confused3

there is always some underlying problem that they dont know of till something happens.

This is normally the case with these cases

I agree there is usually an underlying condition beforehand.
I know I wouldnt ride that ride,I suffer palpatations as it is I think that ride would knock me sidewards.

I feel sorry for her though, but doubt highly it was all the rides blame.

As previous psters have said,I can't really see where the lawsuit can be sucessful? Sad as it is ,they had already ridden it "several" times during the holiday so must have been well aware of what the ride involved. As a side note DW suffered a brain haemorraghe (not disney related) back in 2004 & the one ride she won't do is ToT.Kumba,Montu,Kraken,Hulk,RnRRC..... No probs . I'm assuming the "carrier" bit is because the "liftcar" takes you from front to back? It does seem quite a paltry amount, you would have thought that if "they" thought that they could win, that they would be trying for millions?
SD:thumbsup2

I can't see that the family could possibly win this case :confused3 i bet its no win no fee :headache:

Dad showed me this yesterday and I had to agree with the first comment - "on which of the several times she rode did she decide the restraints were unsatisfactory". There is a lot of speculation that they are hoping to get an easy £10,000 from Disney as an out of court settlement.

As others have said it is a sad case, but in no way is it Disney's fault.

I also find it quite ironic that this case comes soon after somebody tried to sue Disney for not letting her ride ToT several times when it supposedly benefits her health to ride it as much as possible.

I also remembered when this happened+it was in all the papers.I thought to myself then-that they will sue Disney.
It is a terrible, terrible thing that has happened to this girl-but i don't see how Disney has anything to do with this.
How on earth are more restraints going to stop someone from having a heart attack-nothing in the world can stop that. She also went on this ride multiple times before she/they realised it was unsafe-would'nt that take you just the once to realise something like that.Sorry but there's no way this has any sense in it at all.x.

One of the comments on the article stated that it could have taken 3 years to proceed with the lawsuit, i'm not familiar with anything like this so couldn't say for certain.
Also, I wouldn't wonder if Disney might give a sum of money as a goodwill gesture. Not saying whether they should or shouldn't but it wouldn't be the first time a company has done so even if they're not at fault for an incident, one that springs to mind is the Brittney Bergeron case (tons on google about it)
