Good luck with your new contract.

I too have a seller problem, passed ROFR back in June, closing docs sent out July 11, returned mine with money July 12th. Nothing yet from seller.
My contract has a closing date of ON OR BEFORE 8/8, so I dont have a legal reason to be pissed. Closing date was set to allow for maximum time to pass ROFR, do title search and prepare closing docs. Reading coments here leads me to believe the whole process rarely takes that long.

The TSS contract gives the buyer 7 days to sign original, 7 days to secure financing if needed, 7 days to send in down payment. Maybe its time to add to the contracts that the seller is only allowed 7 days to return closing docs.

Would a contingency like that help? Maybe, maybe not. But at least we know sooner that its time to bid on something else instead of sitting back and wondering if its going to close or not!!!

I would love some help understanding what the fees are related to selling a contract & how you split or get the buyer to pay them. Does any of this refer to the very large commission charged by some of these companies?

It seems people use either the Time Share Store or GMAC. Are there others?

We are considering selling one of our BWV contracts & buying into AKL.

Any advice would be greatly appreciated?

I've been reading this thread for advice. Are there any others I should check out.

We are now in waiting mode. 100 points at BWV $90 a point through TTS. August Use Year - 200 points available - all of '06 (Banked) and all of '07. Submitted to Disney for ROFR on 8/6/2007. Buyer (me) is paying closing costs and MFs for 100 '07 points. Will update when I hear back from TTS.

I too have a seller problem, passed ROFR back in June, closing docs sent out July 11, returned mine with money July 12th. Nothing yet from seller.
My contract has a closing date of ON OR BEFORE 8/8, so I dont have a legal reason to be pissed. Closing date was set to allow for maximum time to pass ROFR, do title search and prepare closing docs. Reading coments here leads me to believe the whole process rarely takes that long.

The TSS contract gives the buyer 7 days to sign original, 7 days to secure financing if needed, 7 days to send in down payment. Maybe its time to add to the contracts that the seller is only allowed 7 days to return closing docs.

Would a contingency like that help? Maybe, maybe not. But at least we know sooner that its time to bid on something else instead of sitting back and wondering if its going to close or not!!!

Well, I hope that you have better luck then I did and that your seller gets their docs in today. I also believe that the process in general does not usually take as long as the time allotted. I think we just got bad sellers. I know that I have a great seller for my new contract. TSS spoke to them Thursday night, emailed us both the docs on Thursday night, we both faxed back the signed copies Friday and the contract went for ROFR Friday afternoon. At that point I had already scoped what else might work for me so, I already had a plan when I spoke with Jamie (she's the best) form TSS. Good luck and keep us posted.

A lot of the time the buyer will pay the seller for any MF on points remaining for the current year and the seller will refund the buyer for any MF points that they have borrowed from the coming year.The following were the fees and so forth that were associated with our contract that fell through because it was 10 days past the closing day and the seller was MIA.

Settlement or Closing fee to Timeshare Closing Services Inc-$252.50

I already called TTS in a panic cause Tim's arrival back from Kuwait has been pushed back a few more days and they very kindly reminded me that it will be about another 21 day for the final paperwork to come thru. Whew! They just can't have too many buyers who want this process to slow down <chuckle>:laughing:

Is this the same for people who use GMAC?

The huge commission is what's stopping my husband at the moment. He feels it's so outrageous compared to how little commission our realtors around here make for a LOT MORE work.

We just can't decide what to do.....:confused3

Unfortunatley the deal fell through and I have a new contract in, but because this deal went to closing the seller still owes the TSS comission.
