Any one file an insurance claim with the Post Office on Ebay auction??

What level of shipping service did you purchase? What insurance did you take out on the package?

Is the box damaged? How do you know that it wasn't damaged in his home? And I also think it will entirely depend on your insurance. How much does one sell without the styrofoam inset in the box? That's how I would try to establish value. But technically I gues it's worthless to the buyer? How did you get it?

You're kidding with this, right? This is the first time in my 12+ years of doing ebay that I've ever heard of worthless styrofoam being collector's item. Don't pay the buyer anything. The console was delivered undamaged as promised. The PO won't pay.

An item was sold on Ebay for 90$, but arrived damaged. When the guy (buyer) sent an email stating it was damaged, we figured it might be a little obscure thing, but then he sent pictures which showed significant damage.

We filed out one form to start the process with USPS, but the other guy hasn't heard a word from them. I tried calling the 800 number, but it seems that office is closed due to severe weather in Missouri. Because it's an Ebay auction, there's a limited amount of time to file/settle a dispute. It's been 2 weeks already. And can take up to 30 days for it to be settled.

Now we're also worried about how the Post Office is going to handle it. The item won was a NEO GEO box only (20yr old gaming console) with the styrofoam insert. Finding the box is one thing, finding one with the insert is almost rare. It was the styrofoam that got damaged. How do you think the Post Office is going to handle it, with placing a value on it?

Really trying to figure out the next best option with settling the dispute.

Why is it not in the box in the after photo. The box should show damange as well. Without the box how do you know it did not happen in the person home? Without the damaged outer package I cannot see why the PO would pay it.

Did you ship it in another box? So a box in a box. A 20 year old box might not be strong enough to send even if it appears fine.

Was the box with the foam in another box to negate damages in the shipping? The PO doesn't usually have a problem paying what the eBay autcion was, as long as it was shipped properly. If the box it was in was flimsy, then you might have a problem. Did the buyer already bring it to the PO and show the shipping box as well?

When this happened to me, they had me bring in the entire packing box, and they paid pretty quick. The seller had the pictures of what it looked like when up on auction.

I love this post. I would lol but i'm afraid it might be true. Why would you buy a box and the foam that went with it. I have some topps gum from a pack of 1980 baseball cards. Any interest.

well you can get shafted by the usps.
i sent a $500 item insured.
buyer said it was broke ( as well as I had it packaged she had to have broke it taking it out.)
anyway, post office would NOT pay the claim
BUYER filed a claim with paypal.
I got a broken item back & out the money.

paypal will shaft sellers all the time.

I have learned to take any breakable items to the UPS store. take pics while THEY wrap it. & they guarantee to pay all damage claims.

From the photo posted, it looks like the damage is to the small rectangular area in the center (from left to right). Damage is moving INWARD from both directions (not all to one side as if hit from the side and not DOWN as if hit from the top). are there additional photos of the entire area (like your before photo) showing other damage? A photo of the closed box and also of the entire packaging which shows damage from above?

If this is the only damage, I think the buyer is trying to scam you (and the PO--who may well have contacted him about the claim and he is just not being honest with you because he knows if he takes the items in it is clearly not a damaged in transit thing). I can see that damage easily happening if the buyer tried to take out the styrofoam insert by picking it up by that section and misjudged how hard he could squeeze. Hopefully your buyer is honest, but truly I keep looking at that photo and cannot come up with a scenario of outside the box damage that would cause that type of breakage. I would be very leery of this person if i were you.

Getting a refund will depend on the buyer's postmaster, whether s/he approves the refund. I went through this recently on a reproduction art piece I bought on eBay that arrived broken. The seller had packed it well, with bubble wrap, packing peanuts, and wadded up newspaper. BUT, the shipping box used was a little too flimsy for an eight pound item. The box arrived torn, smashed and appeared to have been ran over! At first my postmaster was very hesitant to approve the refund. She said the shipping box should have been heavier ply, which was true, and she was pretty hateful to me. I think she eventually felt sorry for me when I was at the PO for over 30 minutes, and finally said since I was HER customer, that she would approve the insurance claim. It was a big hassle for both me, and the seller. The PO was definitely at fault. They just didn't want to admit fault and didn't want to pay the claim.

Good luck. Since you have before and after pics, and the box was shipped inside a second box, your claim will likely be paid. They also told me I should wait for notification from my PO to bring the package in to be examined. After three weeks without hearing from them, I took it in anyway. That got the ball rolling and I received a refund within a few days after the postmaster examined the package and submitted her forms. Tell your buyer to get copies of all paperwork from his postmaster.

The guy is a scammer. No way did styrofoam indent itself in such a manner during transport.

In many cases, what's shipped needs to be "properly packaged" to qualify for full coverage. Packaging, itself, without the contents the packaging was designed to protect, is not "properly packaged" as the contents help maintain the integrity of the packaging as much as the other-way-around. That could be a sticking point in this.
