Annual Pass and Transfer of Ownership

Has anyone ever had luck transferring an annual pass to a family member? This would be part of a divorce settlement (believe it or not) - not mine!! But without getting into all the details, if the pass is in the spouse's name who is moving out of state, the other spouse who paid for the pass is staying, and it's incorporated into a divorce that he gets it, would it fly with Disney? It's a long shot, I know .... just want to know if anyone has ever done it before.

2. Someone ELSE (like a friend of divorced party A) would use the AP?

Has the AP been used yet? If so, it will not be transferable. If it is a voucher, then you could get away with the transfer as it is not in anyones name yet.

Annual passes are not transferable. Each spouse should have a pass in their own name, so a transfer should not be necessary. I have not heard of a husband being able to tranfer his pass to his wife (or the other way around)

Yes - Divorced Party "A" would use the pass of divorced party "B" - and it would be in the marital settlement agreement that party "A" gets the pass of party "B".

My suggestion is before they agree to this to ask Disney if Disney will allow it and get that changed over to party A's name if they will. Note that they do not have to.

The divorce settlement will not bind Disney to the terms.

I'm thinking that by the time this all gets hammered out, the AP will have expired.

All passes are non-transferable once used. In the case of any type of annual pass, the name and address of the Passholder is in the Automated Ticketing System. That is why if a person loses their actual pass they can go to any location with an ATS terminal to get the pass reissued.

As WDW is technically a Florida Corporation, it would require action by either a Florida or Federal Court to make a change. If someone were to show up with an Order from, for example, a New Jersey Court there would not be any enforcement possible. It would probably be referred to Disney's Corporate Legal Department who would do research and make a decision if it were an enforceable order on WDW.

By the time Disney Legal got done with it the AP would have probably expired anyway.
