I feel your pain. Just be glad you're not me. I passed ROFR over 2 weeks ago, and b/c the seller is international (and didn't have their **** together), they can't get to a US embassy until 8/10. A full 3 weeks after I sent in my closing documents. This thing is going to drag on.

Yes you are correct documents must be notarized by a US notary (told this by multiple brokers and 2 title agencies that specialize in DVC). For Canadian sellers I've learned (from the boards) this can be very easy but in many foreign countries the only way to access a US notary is at the US embassy. I'm not sure why the other poster didn't have to notarize their documents for sale. My guess is that More than likely the notary for the timeshare store signed that they witnessed the signature even though they didn't.
I suppose if they face timed the signature it could be ok?
I didn't even think to ask the poster who said he didn't need his forms notarized-I just assumed he/she was talking about a Florida property that wasn't DVC. I've never researched this but my understanding is that Florida has a lot more timeshare laws/regulations than many other states (probably due to the sheer number located there).So video notary is a state by state issue. Virginia apparently allows it. Florida does not (at least according to this website--I'm too lazy to research the actual law).

That would be illegal for FL as I understand it.I think the same applies for NV. The timeshare I sold or deeded back as it was. The broker which was used was sumdayvacations and they acted as a closing service also, and they were authorized to act as a notary, and since they had a copy of our photoID we could just sign it snail mail it back.

It's illegal in Nevada as I understand it also. The person must sign while in the presence of the notary.
The 2 witnesses must sign that they witnessed the signature. The notary is witnessing that the person signing is who it says it is. I know for sure they can in FL and I see no reason they couldn't be for other locations. However, the act of notarizing does not count as a witness for FL. For them to be precluded, the statues or rules would have to specifically state they couldn't or that the witnesses had to be different from the notary and I can think of no reason they would do that.Nevada statutes indicate that the person must sign in front of the notary (as I understand it). The notary verifies the signer is who they say they are by an ID or if they know the person that is also acceptable but they must also see the person they are verifying is the one who signs. That is separate from the witnesses. I'm not positive if the notary can be a witness also but believe they can be.
Just checked today and the points are loaded into the system ,now onto the planning for next year /LOVE MY DVC.Finally closed on my new OKW add on contract today , it went about 8 days late due to some missing paper work from the sellers. Now just got to get it into the Disney system .
