13 Year old gir declared brain dead has now officially died

In a declaration filed with the federal action by Jahi's family, Dr. Paul Byrne, a pediatrician who has questioned the definition of brain death, said he visited Jahi's bedside and observed her responding to her grandmother's voice and touch with a squirming movement.

"In my professional opinion, she is not a cadaver," Byrne said. "Her heart beats thousands of times a day."
 
I'm curious as to why the judge granted her more time. Does he/she not think this child is brain dead as per all the doctors?

I read that he wants to give the family time to file an appeal. If the appellate court disagrees with his decision, their ruling would be moot if the ventilator was removed.
 

that's what I thought. Apparently this doctor is in agreement with Jahi's mother, that the heart is beating so the child is still alive. California is a Daubert jurisdiction. Ultimately the court is going to have to reject Dr. Byrnes' medical opinions.

It sounds to me that this doctor is the one giving them hope. If they have people like this offering advice/counseling and an unfounded medical opinion, they'll never come to terms with the reality. I hate to see people exploiting this family for their own gain, which it seems so many are doing - from this guy to the "rehab" facility claiming they will take her.

I didn't think there were any cases of someone being truly brain dead and coming back.
There have been cases of people being misdiagnosed as being brain dead and coming back. But I don't think that's the case here.

I took the question to mean have there been cases of people being declared brain dead and coming back. Yes there have been. It is very rare.
 
Off the wall and merely theoretical question, since she is legally dead does she need to be moved to a registered health care facility, could she be moved to a registered mortury?

Pretty much. Since the parents aren't willing or able to do it I really wish the hospital and/or courts would step in and say enough is enough. There is no actual life left in that child, she is essentially a dead body attached to a machine taking up space in a hospital that can be used to actually treat a living patient with a chance of recovery.

sounds like the judge does not want to make the call. I hope he is an elected judge & does not get re-elected.
 
I took the question to mean have there been cases of people being declared brain dead and coming back. Yes there have been. It is very rare.

I read a couple of stories about people with severed brain stems (considered brain dead) come off a ventilator and are living happy healthy lives.

Three woman in a single year, first they were irrevocably dead, and then they weren't. Before them, there was Zack Dunlap.

None of the cases cited in the Yahoo article appear to be at all like this case. At least some of them involve a brain trauma, which makes diagnosis difficult if not impossible. No brain trauma in this case.

Second, these cases all involve people who "woke up" in a matter of days...not weeks.

Here, we have a young girl who has been completely unresponsive (as determined by no less than 5 doctors, three of whom were selected by her parents) for weeks. Weeks. Not days.

The chances that there is some sort of mistake is non-existent. The only person offering a contrary opinion is a doctor who is frankly, a quack. He is someone who simply does not believe in brain death. As such, he is in the tiny minority of medical professionals with this archaic and misguided belief. And, this is the downside of the internet...any quack, charlatan, or just plain weirdo can create a website and offer whatever misguided "opinion" they want. We need to be very skeptical of this kind of crap. Same with the "facility" that is supposedly ready to accept her. They have NO building. They have NO doctors. They have a hairdresser and a funeral home operator who offer day "therapy" to people who have TBI. Exactly where is the body of this young lady going to go? She is in ICU at the moment, hooked up to a ventilator. Around the clock, intensive treatment is needed...not "day" therapy.

I feel very bad for these parents, being led even further astray by charlatans and wackos.

I have read about several of the cases and the people woke up within days or hours, not weeks.

My mother in law is in a nursing home, barely able to communicate. I had a great aunt linger for years in a nursing home while she never seemed to notice us visit. So I don't understand why the mom thinks letting her daughter remain that way would be a better option than death? I know the answer is that the mom thinks the daughter will wake up and be fine but I just can't wrap my mind around it.

California does elect its trial court judges.

The Governor can appoint a judge to an open position until the term expires. I looked up the history of Evelio Grillo, and he was appointed in 2003 and served the rest of the term (until 2012) where he ran unopposed.

He was the judge who delayed the public release of the UC Davis pepper spray report. I think it was assigned to him because the University of California's headquarters are in Oakland, where the report was prepared and was going to be released.
 
I don't know the difference between this case and the cases cited in the article,where people woke up after being "brain dead". I don't think any of us could really tell the difference.

Well, the first three mentioned weren't even in the US, so "brain dead" could be determined much differently in other countries.
