I was already convinced that Disney was going to exercise ROFR...but they didn't!!!

Yea! We will soon own 420 Boardwalk points!

I am so excited!

Congrats! Wow, I bet you won't be able to sleep tonight. I know I would be running all the scenarios through my mind on how to spend those points. :thumbsup2

Congrats!! Did you submit ROFR for BCV on the same day? I'm wishing you lots of pixie dust on that one, too. Now that you are actually a "member", your chances of getting BCV are better.

Anytime points are sold between private parties, the agreement/contract setting forth the terms of the transaction the parties have agreed upon goes to Disney. They have the right to purchase the points from the seller on the same conditions (price) as those agreed upon by the parties or passing on it and letting the deal go through.

The process of being offered the points is called "Right of First Refusal" and if Disney decides not to buy the points, you will hear that the sale "passed." If you search for ROFR on the board, you will find several threads that catalog contracts that were taken by Disney in ROFR, contracts that passed, and contracts that are waiting in ROFR for a decision.

While ROFR is not unheard of in timeshare contracts, Disney is one of the few resorts that enforces it. It both gives them a source of points to resell in sold-out resorts and helps maintain the price point for DVC.

As chip1 said, it is right of first refusal. That may not answer your question, though. ROFR is the process one must go through with Disney when buying a resale DVC contract. Once you agree on a price with the current owner, the contract must pass Disney's muster, and if they think the selling price is too low, then Disney will buy the contract. It's a source of much consternation for those involved in the process. paw:
