WWYD house misrepresented....

DH bought us a modular home that was listed as being 28' x 60' now that we have actually seen the home it is actually 24'x 44'. DH paid cash for the home without me seeing it. The home is VERY NICE in an area we love on a road we love at a price that can not be matched but much smaller than what I was looking for.

I really really hate the kitchen there just not much hope for it I been spoiled with lots an lots of countertop space nice cabinets huge pantry etc that this kitchen will never have yet I don't do as much cooking since the DD's are grown.

I hate dining rooms love eat in kitchens which I'm also giving up but dh would never have a wall taken out to give me my eat in kitchen.
 
When you say it was listed as 28 x 60, who or where was it listed as this size...on the real estate ad, on the contracts, on the deed??? If it was misrepresented on any of the legal documents, I would say you should speak with an attorney.

I can't tell from your post whether you want to stay there or move somewhere larger. I think that is a question that only you can answer. Since you got it at really good price, can you add on? Good luck with whatever you decide.

Then he needs to see an Attorney ASAP, that is not legal and it sounds like the may have "baited and switched" up on you. That would really suck as those dimensions are wayyyyyy off:eek:
 
In any legal documents, thats's considered fraud and you need to talk to a real estate attorney. You may be able to get some money back if you want to stay there and all of it back if you don't.

This doesn't make sense - LOL! You bought the home - I mean signed the documents that lists the square footage, lot size, etc, and didn't read it? If you're saying that it's not what you signed for, then yes, you have a problem. What is listed on your documents?
 
There has to be more to this.

I can't believe anyone would buy something like a house without seeing it first.

Also be aware that there may very well be language somewhere, probably in fine print, that covers the builder for something like this. When we had our house built there was language in the original contract that alerted us to the fact that there may need to be changes to the original design and dimensions due to local zoning requirements or limitations of the home site.
 
For those wondering, especially when dealing foreclosures it's pretty common to have NO idea what you are getting into. If you know what will be on auction in advance, you can do a driveby but you can't walk in or anything (usually). Especially since the OP's DH paid cash, I am inclined to think this is what happened.

To the OP, if what I am thinking is correct, I am not sure what recourse you have if it was bought at an auction. Maybe fix it up and flip it? That's what many people do with foreclosures.
 
If you bought it at auction you may be able to sue the auction company for misrepresentation but your only option may be to pull out of it or deal with it. I don't know what you mean by modular home. Here modular means the house comes to the build site in sections and they assemble it on site. I guess the other definition would be the type that comes in two sections and they take the wheels off of it. The first type is a normal home and you can just add on but the second would be hard to add on as it does not have a foundation but a frame. It sounds like you like it and i would deal with the auction company. You may be able to recoup some of the fees you paid them but may be not much more. You have nothing to loose, see what pans out. At the very least you must make sure the proper size and appraised value is correct on the city/county records as that is what establishes your property taxes. Good luck.
 
Is there a contact? What is the EXACT wording of the contract? Did neither of you see the home before hand? What is the EXACT wording of the listing?
 
More detail needed. If you purchased a new modular home and what was delivered to the site was smaller than what was ordered and paid for that's one thing.

If you purchased an existing modular home that was available for inspection and the contract and deed are accurate but you're disappointed to learn that the home is smaller than expected that's quite a different situation.
