WWYD Ebay Misrepresentation

I paid $500 plus $150 shipping for two new leather dining chairs. Although the manufacturer's website was quoted about leather having distinctive differences in hides, the chairs have very visible lines across the leather, with significant scuffing on both. They came from an outlet, obviously, but I was under the impression from the description they came from the store. I believe there should have been some indication of the imperfections. This is a big seller and I don't think my negative feedback would be much of an impact and any return would be cost prohibitive. So, WWYD? TIA for any advice.

Hopefully you paid with payPal and can file a claim with them. PayPal purchases are protected, so that would be your first place to try and either get a partial refund or be able to send back the item for a full refund.
Of course, you should first contact the seller and begin the process that way.

Found this for you on the FTC website:

Because of things like this, I have stopped purchasing items on eBay. Occasionally I will sell items I no longer need, but otherwise I try to avoid eBay altogether.

Example: About a year ago, I purchased a "new" iPod Nano on eBay for $129 instead of the list price of $149. When the item arrived, I immediately saw it was used heavily due to the high amount of scratches on the front, back, sides, the sticky brown substance on the earbuds and USB cable, and the fact that it was shipped in a box for the original iPod. I contacted the seller multiple times, but she refused to give me a refund. I then contacted PayPal and even though it was just one week since I purchased the item, they said that my time to lodge a complaint was over and what was done is done. I have not purchased anything on eBay since... :sad2:

OMG, just one week! I purchased these last Sunday, but they did not mail until late last week. I received them today. The lines are noticeable, even in a dimly lit room. I dread to think what they will look like in the sunlight.

Normally you have I believe at least 30 days from the date of sale with paypal and 45 days with ebay.

Leather does have imperfections, sometimes they do look like scuff marks, sometimes they are scuff marks.

We have a nice leather sofa and loveseat (buckskin) and most if not all of the scuff marks from use will come out with a cream leather cleaner. I would try that first.

Genuine leather furniture, I have learned, scuffs very easily, but it also cleans up nicely with the right product. (I use it at least once a month). I can scuff it with my fingernails running over it very lightly....

If it was just scuffs, I would forget it. But, there are thin lines across the back and seats of the chairs, distinct lines, just as if a pencil was used with a straightedge to make a discolored line. I think that I deserved to be told that these were seconds from the Outlet store, not the same chairs that would be sold in the stores or online (they were Restoration Hardware).

Did you pay with a credit card? While Paypal can be less than helpful at times, my credit card company has never failed me (and I had a dispute earlier this year over a new Dell laptop that was about $1000 :rolleyes1 ).

While I agree with the other posters about having to be very careful with ebay purchases, I just make sure I make my purchases through Paypal with a credit card (to make sure I'm protected).

Contact the seller about the misrepresentation. If the listing is still available, print it out for your records. Especially if there are photos showing the chairs in a different state. Then if the seller doesn't do anything to your satisfaction, save your communication and file a paypal dispute. Also file a complaint with ebay- especially if they list a lot of items.

If paypal doesn't do anything, file a dispute with your bank or credit card company.

Thanks for all the advice. I contacted the seller and let her know I felt that the description was not accurate. She used the online RH picture, not a picture of either chair (the lines would have been apparent in a photo of the actual chairs). She quoted the price they would have cost from RH in her description and said they came from RH. I don't think she will reply, but I will keep my fingers crossed. I read some recent negative feedback, which all mentioned poor communication.

Hoping for some more advice. Was it acceptable to use the RH's picture in their listing? I sent two emails (one through ebay and one to their personal email address) and have not received any response. If I don't hear anything by Monday, I will contact ebay directly, followed by Paypal and my cc company. Thanks for all the previous suggestions.
