I had specifically said I was not answering for her. It was my understanding that any posts here could be responded to. I thought a rule of the Dis was that the forums were not for personal conversations and that any member could respond. Many on the Dis comment on posts that quoted others. So again, excuse me for infringing.I asked them specifically what they meant by it. No one else can answer that for her.
I'm certainly open to hearing your answer to the question about implied consent.
The definition of implied consent is consent which is not expressly granted by a person, but rather implicitly granted by a person's actions and the facts and circumstances of a particular situation (or in some cases, by a person's silence or inaction). It has sometimes been used by the defense in "date rape" cases in which there is a claim of assumed consent due to absence of protest or a belief that "no" really meant "yes," "maybe" or "later." IF this was a case of actual rape, then implied consent would be irrelevant. IF the woman was drunk or incoherent that morning AFTER drinking the night before (instead of having a hangover but no longer being intoxicated), then it would also be irrelevant. As many here have said, we do NOT really know the facts yet. We know what the news media put out, without complete details as to their relationship for the last six months (beyond the "just friends" description) plus his side of the story about what happened. It is up to the court to weigh the facts and judge the case. IF it was rape, he will be convicted.
