Who is responsible for this?

My neighbors have a huge weeping willow tree that is on their property but some of the branches hang over onto my property.

Today is very windy and a huge branch fell from that tree, and got caught in another tree but is hanging over my fence, I shouldnt even call it a branch, its more like part of the tree. Its wedged in the other tree pretty good and doesnt look like it will fall.

My question is who is responsible for getting rid of that branch, me because the branch was hanging on over our property, or the neighbor because it is his tree?

i think if it's entangled on a tree that falls on their property it is their responsibilty. talk to them and see if they will nicely do something, if they don't and it causes damage to your property they could have a civil liability (esp. if you have put them on notice). i think you can also trim anything that intrudes into your property. check online at the nolo press site-they have lots of good information on laws regarding neighbor/property issues.

It depends on your neighbors some would gladly pay and others would be like..Snooze or lose I dont knowt he actual law but I would suggest talking to your neighbors.

If it came from the tree on their property, it is their responsibility. After handling many insurance claims of that nature it always came down to whose tree the property was on.

As an extention of that frame of reference what about during a storm? Who is legally responsible for damages caused by an "act of God?"
