The couple is worried about what others will think about their baby being of mixed race, but they aren't at all concerned what the town thinks of them being parenting lesbians? :confused3

On one hand, I think she might have a good case. She was PURCHASING a product, and it was not what she ordered.

On the other hand, she should be thankful she was able to give birth to a healthy, beautiful child.

I'm torn.
 
Race aside, this was a medical error. This couple had every right to decide the criteria for the sperm that the bio mother would be inseminated with. There are so many variables besides the what meets the eye. When dealing with something as personal as conceiving a child greater care should've been taken to ensure this couple received what they probably took great care in choosing.

People may be giving her crazy looks because they are wondering why they are cutting the child's hair. Surely they have a few black friends, neighbors, coworkers...who they can ask to teach them how to take care of their daughter's hair.

Exactly, the donor isn't who the couple picked out. They can still love their child unconditionally (I'm not saying they are) and sue for damages.
 

Are you purposely trying to spark a race debate? The title of the thread is extremely inflamatory and wrong.

The woman is white and wanted a white donor and she didn't get it, give you a break why? I think the woman is well within her rights, she is white and so is her partner and they wanted a white child there is nothing wrong about that.

Why don't you give everyone a break and stop the race bating.

Exactly. If I were in her shoes, I'd have picked a donor with genetic traits similar to my own -- I'd hope to have a child who'd look something like me in terms of skin color, hair color, height, etc.

Exactly. THIs was a huge mistake. There is no give me a break about it. This place screwed up.
 
No doubt it's a medical error, but complaining about having to travel to have her hair done seems to be such a trivial complaint. My word, can't she learn how to do the little girl's hair?

I would be thinking I am lucky to have a healthy child. People adopt children who have no similar appearances to themselves all the time. What guarantee did they have that their "order" would be correct?

If mom had just left it at a contractual/medical error--I agree with you.

But her racist comments do not endear me to her. To me--she is not loving her child unconditionally in that regard and if makes me wonder if she has some racism towards her daughter she may not be aware of.

For example--she seriously cannot find any salon anywhere that will cut her child's hair without going to the "special" parts of town?

If you came on here contesting a transaction that was a contractual error, but then inserted racism, your legitimate claim would be overshadowed by the racism.

Some how, I don't believe she would be suing if the error gave her a white baby.

Not familiar with their particular place, but from what I understand it's usually supposed to be pretty darned "guaranteed" all the way down to eye color, educational background, profession, etc. They don't just grab random samples from the shelf (unless you request that).

I agree that of all the complaints, the hair one is just plain dumb, but I would be incredibly upset.

What guarantee? They made a specific choice of a donor. That needs to be a guarantee.
 
While I guess it is a medical error, the fact is (like it or not) the sperm bank was participating in a buisness transaction, and they have an obligation to live up to the contract. If the woman picked sperm donor #2 and the sperm she got was from a different donor, the sperm bank is in breach of contract, and she SHOULD sue them for failure to comply with the terms of the contract.

All the other stuff that she says about sending the chidl to a school where she doesn't fit in, difficulty getting her hair cared for, etc. is just extra things to back up her case, and probably (I imagine) to add to the pain and suffering that will no doubt be awarded to her.

It's all well and good to say "she should be happy with any healthy child", but they DID promise to give her a child from the sperm donor she chose. And they didn't do that.
 
I had other details in mind. Such as the health of the child. If the hair and the eye color are not what they wanted, by all means, give the child up for adoption. Perhaps they aren't up for the challenge of a child with brown eyes. (Typed with all the sarcasm I can muster.)

Come on. I'm sure they love the child and will keep it, but if you go in for a nose job and come out with a bigger chest instead, is it enough to say "oh well, at least you woke up healthy!". They paid for a medical procedure. What they requested isn't what they received.
