What do to when the name does not match the check

Some one gave me a check with my first name dhs last name I did not take his last name so how do I fix this problem
 
And deposit it at an ATM. I had a lot of checks made out to my mom after she passed away, no problem depositing them due to the name on them.
 

It's probably different up here but I alerted my bank that I had gone back to my maiden name but I still use cheques that have my married name in the corner. I even sign with my maiden name and haven't had a problem yet. I only have 3 cheques left and will order more with my new name. It's funny though because I am moving in March and getting married in December so I will have tons of outdated cheques again lol
 
Order your checks from VistaPrint. You can get just 25 at a time if you want. They're reasonably priced and good quality.

My checks have the right name on them but for the date they have 19_ _. printed on them- that's how long ago I bought the checks, I never use the dang things! I am actually going to just shred the rest and buy new ones so I can move in the 2,000's LOL. I didn't even have that many to start with, I probably bought like 500.
 
This happens to be too. I never took my husbands name either.

So at Holiday time when this happened I signed it Mrs. Sgt Mickey Mouse-Duck

but at the bank they call me Mrs Duck anyway even though all my paperwork says Mrs Mouse.

It would be preferable to go through a teller and perhaps the branch manager in such a case as the situation you described, tyguy, presents legal issues. Banks do review such matters and could have refused to accept the checks upon review, instead requiring the executor or personal representative of her estate to handle them through her estate. I had a similar situation where a check was made out to a deceased parent and was accepted for deposit to the other (disabled) parent's account for whom I held power of attorney, but it required manager approval. The manager was familiar with the circumstances of all concerned and made an exception to usual practice and policy for expediency's sake since the check was only a few hundred dollars.
