We're Moving

We bought our first house almost four years ago. It's about 30 years old. We've enjoyed it while we've been here, but are ready for something a little newer. So, we are purchasing a house that is three years old. The seller is also the builder and has another house for sale. Because of this, they are very anxious to sell. So, they are taking our house in exchange and they will sell it. We have verbal agreements on both houses. But, I am so stressed out right now. It seems like the whole town knows we are moving. We still have to have both homes inspected, so it could still fall through. But, we are very excited about all of it. We close in three weeks and go on vacation that next week. Send pixie dust our way that everything works out great.

Verbal???? Do you plan to enter into a contract once the inspections are done? Do you have a lawyer?

You definitely need a lawyer. Verbal agreements with respect to property are generally not recognized as a legally binding contract.

I meant that it is as far as the verbal agreements. It's now in writing on one end, just waiting for the other end. We've agreed to all the terms. It is a law in Iowa that you have to have a lawyer. I just meant we've got all the details worked out, it's getting the paperwork filled out. Sorry I wasn't clear on that.

What an unusual arrangement, but in today's market you need to be creative to sell your house.

My only concern was that builders these days are desperate and you need to be careful. Glad to hear you are :)

All the papers are signed. We are now waiting on inspections and then we are done. If all goes well, we are moving next weekend. I supposed I should pack.

When this whole process started, it was all working out so well that we either said it's too good to be true or it's meant to be. And, after the inspection yesterday, it's too good to be true. We are hoping at this point that we are going to be able to just walk away from the whole thing. The agreement says that our purchasing is subject to our approval of the inspection, and we were just not happy. We're a little bummed, but at the same time, we're okay with it.
