hi im going to orlando next year in may.

And my passport runs out in aug now i do not no if i will need a new passport and if i do will i need a visa as my new passport will be from 2005

or can i use the visa waiver form still

Your passport needs to be valid for 90 days after your return date to be allowed into the USA.

That means that you will have to renew your passport and get a visa as your passport will have been issued after 26th Oct 04.

That is not correct. The decision from October 2004 to have biometric passports only and all other new passprts to have a visa was put back to October 2005. All machine readable passports are still valid with the waiver as long as you have the 90 days rule met. Of course if you are not entitled to travel on the waiver for other reasons you still need a visa.

so if i get a new passport now i can go under visa waiver form as my passport will be issued before October 2005.

im only going for 17 nights

Also wrong. The requirement for 90 days past end of holiday is actually 6 months and is waived for UK passport holders. It must be valid until the date of departure, or admission will only be granted until the expiry date.

AFAIK, machine readable passports issued before October 2005 will remain valid for VWP entry until their expiry date.

If you wish to be entitled to the full 90 days you are entitled to stay you must have at least the 90 days left on your passport, that is where it links into being requested to leave it it is any less. This is what you have referred to and what i did mean Pat (Honest) :rotfl:

I was so happy with the deferral as 2 of our 4 passports are due for renewal prior to October 2005. Just confirmed with the UKPS that you can renew a passport at any time so i will be renewing 7 months early to ensure that i can travel on the MRP and waiver next time, if i wait till March i would have to travel with a visa.

I'm so glad everyone cleared that up for me as my mum renewed her passport in Nov 04 and we weren't sure whether she'd need a visa.

Interesting point about renewing early though... how much is a VISA does anyone know? I think my passport expires in July 06 so may be worth paying out for a new one if it saves me having to get a visa for the next 10 years!

Yes it will.

I am not sure of visa costs, but there is no guarantee that any visa would be valid for the life of the passport. Also, it is being trailed that the new biometric passports will be considerably more expensive than the current ones.
 
It is not particulary the cost of a Visa that will make me renew early. It is the travel to London etc for us both and the kids to get the visas, i just cant be doing with that. :moped:

My two boys aged 13 + 16 at time of travell both have their own passports which run out march 06, we travel july 05 and return end of august, do i need to do anythiing about visa's or are we ok??????

You are fine for this visit on the VWP, only NEW passports issues after October 26th 2005 will have to be accompanied by a visa to travel to the US.
