Transferring Points- Monetary Consideration

I see on the rent/trade board, people advertising points for transfer. As I read the rules, transfers can't be made for a monetary consideration.

What happens here? A deal is done and you call MS and arrange the transfer w/o saying that the points being transferred were sold?

Also while it limits the number of potential purchasers, isn't it better to put points up for transfer, get paid and then make the transfer, as opposed to making a reservation for someone who then may change their mind?

That is one side of the story. What about the person who is expected to send money to a complete stranger and also have to provide him/her with your DVC number so that the transaction can be completed? There are two sides to each equation.

DVC will not ask whether the points were sold and, since points themselves have no real value, the monetary issue is for the "service" provided and not for the points. Disney has likely worded it this way so as not to allow any question about the "value" of a point. The clause in the contract basically means that DVC will not enter into any dispute about payment between parties- especially since the transfer can't be reversed later.

As for any form of rental, it is up to the parties involved to negotiate terms they can live with before doing anything. Either a rental or transfer can be done with little risk as long as the terms are set up properly.

DVC doesn't care about the transfer issue from a financial standpoint. One who transfers points should get paid in large part or totally prior to the transfer for their protection.
