I am sitting here just stunned by it all...

all I can think to is that my boyfriend in high school should have been arrested then ????

Th issue is NOT when he started having sex in this...
it is that SHE WAS CONSENTING, SHE INNITIATED and HE lost everything because of it

I hear of too many complete dirtbags that should be in doing serious time but get out with a smack on the wrist an offenders status and they are on there way...

As devil's advocate - I might say he never got caught doing any of those things. I find it hard to believe if all his buddies weren't doing it, that he wasn't doing it too. (Not that it changes the legitimacy of your argument).

And I love debates on the DIS that don't turn into personal attacks and name-calling. I have gained a lot of perspective and insight in many different situations from the very intelligent people we have here.

Trust me, I hung out with some very interesting people during my early 20s. But NOT once did I do the drugs or drinking they did. NOT once did I do the other things they did. It's very possible to hang out and be with a group of people, but not get caught up in everything they did. Many times I have looked back on some of the things, and think YIKES! I could have got in a lot of trouble with just hanging out.


I still say under 16 or not, the little girl should have had to face some time also.

Back to the topic at hand. I wonder how many times this man preyed upon younger girls under the age of consent and committed statutory rape without being caught. His behavior and lack of morals is what landed him in jail. Blame the state all you want but HIS actions landed him in jail. He has no one to blame but himself.

and that's why is so out of whack. all things considered, if I were at the same age and in the same venue, I'm not going to ask to see a girl's ID to make sure she's within three years of my age.

and that's providing I knew the law, and that oral sex was a felony. hell, at that point, I 'd rather suggest we do the real deed and risk her getting pregnant.

that would only be a misdemeanor, and I wouldn't spend ten years in prison for accepting her .......

well unfortunately a lot of kids are held responsible for their upbringing - which is NOT THEIR FAULT...
I had to learn a lot of lessons the hard way (nothing that bad - I thought drinking at 16 was bad mind you) and as an adult I would be MORTIFIED if my DD was getting smashed at 16...
he was to young to even KNOW that it was a felony for heavens sake...

The DA has the right to prosecute or not in any situation and my belief is that this is one that should never have been prosecuted. I work with kids in foster care. Many of them have been sexually abused by their fathers, etc and most of those people are not in jail, many never even prosecuted. In this case, however, when the girl stated that she did it (not him), I would never have prosecuted. I hope he gets out and finds people that are willing to help him make his dreams come true!

As for the kid, While I do find the jail time to much. He did break the law. But so did she. Where is her jail time?

As for the girl, I think the law would say that she was under the age of consent and could not legally give her consent to the sex act....which is utterly stupid.

She didn't break the law...and in my opinion (and what is now the changed law after his case in GA)...neither did he. The only reason he is in jail is the whole oral sex thing. He was NOT punished for the drugs or the alcohol. Seriously...you don't go to jail for FIRST TIME alcohol or pot smoking. NOBODY does. I won't debate if it were his first time or not...that doesn't matter. This was the FIRST TIME he was found with drugs or alcohol. THANK GOODNESS we don't try and play around with "I bet he did it before" in courts!! So, first time alcohol and pot possession would NOT have landed him in jail for any length of time. Nor would it label him a sex offender for life.

The only issue he was jailed for is the whole oral sex thing. So...I don't think he broke the law (at least a law that should be a law...and the law makers in GA agree with this statement and have changed the law) nor did she for that matter. Did they do something wrong? HECK YEAH(if I am being a moral critic)...but if they should be in jail for oral sex then we might want to start the nation wide round up at EVERY high school in the US. Not one will find us without someone (and usually many someones) to throw in jail over the "law breaking" oral sex among consenting teens law (totally being tounge in cheek and not to you...but to the dumb law at the time and to the idiot who thought to go forward with this in court (aka the DA). So prepare yourselves DISERS (and your children) jail time is coming....
