This is just so sad,,and makes me ask WHY would someone do this?? I don't call it 'playing'??

I'm 99.99% sure the bottom windows are fixed like a wall and do not open. There is no barrier, and would be a huge liability for the cruise line. (If sweet Chloe fell out of bottom window, I would blame RCCL as there is no protection.)

My guess as to why they are clear is because they are fixed and provide a better view versus the tinted, but the tint is important for the windows that can open so you can tell the difference between open and closed ones.
I wonder if someone is going to claim that since the bottom windows are clear and closed, it would be easy to mistake an open window as actually being closed.

Because the windows go all the way down to toddler level, I’ve never been convinced by the “I put her up high, so she could bang on the glass” story. She could bang on the glass while standing on the floor. I suspect he put her on the railing or sill so she could feel the breeze or for a photo, etc.. He just didn’t count on her wriggling, squirming, leaning forward. No way he didn’t realize that window was open.

The bottom windows are not only "closed", they are sealed and not able to be opened at all. As I posted before, I have also been on this ship and many other Royal ships (and other lines) and it's very obvious when these windows are open. The upper windows open for a very good reason and that's air circulation. The railing is a hand rail and not a seat. Just so many reasons that Royal is not at fault.

So I just looked at the video posted of the deck, and it looks at first to me that every other window is tinted. Only as you proceed halfway down the deck do you get to a point where there is a window obviously open. Until then it just looks like they are all closed, but not all are tinted.

To me they look as clear as the closed windows above them, not as clear as the open ones. The only reason the windows next to the opens ones are extra obvious because its double tint, tint on tint, one window slid over another.

I could understand someone looking from a distance, unfamiliar with how it works, thinking all the windows are closed. But once you get close, even on the video, it's obvious what's open. Then when you add noise or a breeze, do you really think someone standing next to one of the open windows would really think it's closed?

The photo included in this article which shows the wall of windows after the accident... are they all shut? because I can't see any difference to indicate open or shut like so many other photos showed.
Well, due to my ad blocker I was only able to get a quick look at that picture. It was taken at night, apparently. And the accident occurred shortly after boarding (typically in the afternoon). So I'd say the picture was taken "later".
 
I’d be a lot more willing to say, “He had a massive lapse in judgment which cost his granddaughter’s life, but since the baby’s parents don’t want him punished, don’t pursue legal charges,” IF the family hadn’t hired an attorney who seriously spun the story and is trying to hold the cruise company responsible. And that was before the body was cold. At that point, they asked for karma to smack them.

I completely agree. While I feel awful for the grandfather, my sympathy is severely diminished by the legal action taken by the family nearly immediately and placing all the blame on the cruise line with a barely factual story.
