The graphics showed open area, nothing obstructing it. WIDE OPEN, with no lounge chairs, no table & chairs - nothing. Which clearly isn't true. Also, it showed a ever so faint tint. Barely noticeable, nothing like the real thing.

I noticed that too. It didn't look like the photos I'd seen here on this thread.

It's a cruise ship. The whole thing is open air with railings, including stateroom balconies, over which a fall is likely to be deadly. Screens over that open window??? Really??

There is a railing at adult mid torso level and a gap between the rail and the window for extra protection. If grandpa didn't see that the window was open, maybe he wouldn't have seen a screen either. (I have run into a screen door before) Sadly, even if a screen was up it doesn't automatically prevent this type of incident. Her body weight would have likely pushed the screen out with her. :sad1:

And then when the wind or a bird creates a hole in the netting, let's blame the cruiseline for not immediately fixing it. If the grandfather had held her up on a railing at Disney and dropped her 20 feet to the ground, would it be Disney's fault for not putting netting over every walkway?
 
I watched the interview as a parent and a grandparent, I cried watching those people, its heartbreaking.
But sadly, the child would not have gone out that window if Grandpa didn't put her up to it, its a pure and simple fact. I'm sorry its his fault.
Bad situation all around, RCCL should not settle.

Exactly. When the mother started saying they should get different ventilation methods, she lost all credibility IMO. Should any place, building, ship, bus anything that has windows never open it ever on the off chance that someone who's doing something they aren't supposed to be doing falls through it? Like, what? She essentially stopped short of saying cruise ships should be completely encased in glass like a floating bubble on the ocean. Its such a grasp at straws, I'm sure so they can place blame outside of their family while getting a monetary settlement to help their adjustment to their new normal. I get it, but the case is a reach. I'll give them the benefit of the doubt that their grief has clouded their judgment.
 
Interesting that the lawyer is saying they are seeking the footage when I thought RCL had offered it to them already.
The cruise line gave the video to the police. And offered the parents a chance to view it.

The lawyer can't get the video until there's a court case, from what I understand.

I believe there are 2 different lawyers involved... the grandfather's criminal defense attorney and the family's civil lawsuit attorney. And possibly a 3rd, with both a Puerto Rico and US attorneys working on the defense. It was my understanding that the video was provided to police, who shared it with the criminal defense team. The civil lawyer (the one representing the parents in the Today interview) likely has no "rights" to the video until or unless it is made public. The police offered the parents opportunity to view the video and they refused.

What I haven't figured out is whether that video shows the onboard location leading up to the incident, or an external view. Presumably an onboard view.

While I understand the family wanting to place blame elsewhere, and I do believe the grandfather truly didn't realize in the moment that the window was open, I don't see this as the cruiseline's fault. However, they will likely settle to keep it out of the public eye any more than necessary.

You're on camera wherever you go on the ship and there are cameras monitoring the sides of the ship, so I would wager a guess there are two different videos, one from inside the ship and one on the outside.

Do they? That's common belief, but I'm not so sure it's entirely true. DCL had a case several years ago of a CM who purported went overboard...but they were unable to track her final movements onboard and did not have video showing overboard. Maybe newer ships do, but I would think it's a massive retro-fit for older ships. But I can't say whether Freedom of the Seas had overboard sensors/cameras or not. Or maybe they do in certain areas. I have no doubt there's video, just what angle/view, but supposedly it very clearly shows the incident.

I couldn't watch the video without weeping for the family.

I also can understand why they feel the desperate need to blame someone else. But the mother, as an attorney, should know better, especially if you are unwilling to see the video, you cannot proclaim fault.

I can see RCCL settling, but I think it really depends on what the video shows. It will all turn on whether it was reasonable for the grandfather to conclude that there was no glass, and all of the issues with the railing, etc will be brought up. Is it reasonable for the grandfather to stand a baby on a railing and let go even if there were glass there?

A jury will see the video if this goes to court. And I think that is more detrimental to the parents than it would be to RCCL.

The animation is a misrepresentation.
The narrative that the window is in a child's play area is a misrepresentation.
The narrative that the video is being kept from the family is a misrepresentation.

I'm not just lying blame on the family or the attorney for misrepresenting the facts. Today show is also to blame, but they're not the only ones to blame. The family and attorney repeatedly refer to it as as window in a children's play area, which isn't true.

The drawings left out a key component ... the railing he put her on and the gap between the railing and the window.
