We have been watching the ads for our ideal UY/points/home resort for a while.

One came up at the Timeshare Store.

We had just left for a two night vacation when I found it. We called and were told that we needed to send in a check for the deposit. The check needed to get there within seven days. That was great, we didn't bring our checkbook on our trip.

When we got home, I checked online and saw that 'our' contract was marked as pending. Well, it wasn't pending for us. It was sold out from under us.:headache:

Maybe I misunderstood, but I could have given them my VISA number to hold it until the check arrived. Or I could have had the funds wired. These options were not offered to me.

I realize that there will be another contract that we like just as well, but, it did take me many months of checking daily to find this one.

I am really sorry that happened to you.

Unfortunately, from my understanding, until you have signed contracts by both buyer and seller, the deal can be rescinded at any time during that 7 day period.

Did you call TSS and find out what happened? I'd be curious as to why it went to another buyer.

Hopefully, though, something else will show up soon.
 
It sounds like they did not even wait the 7 days???? I would certainly find out what happened, if it was 7 days or more then were doing what was in the best interest of the seller - the one who pays the commission. Sorry this happened to you real bummer!
 
Well, I finally got in touch with 'my' sales rep. The rep took a few days off right after our call, and no one else knew anything.

According to the rep I WAS told I could use my credit card over the phone, strange that I have no recollection of that.

I wonder if I need one of those 'quality control' recorders for my personal use. :rolleyes1

In any case, the contract is gone. And the rep was just so darn perky about the whole thing.

I am still not happy,but the hunt continues!!!

Fidelitylet us put both the deposit and the next 1500 on credit card. Notsure if this is standard, but maybe it will help in the future. Good luck with your search!

I was unaware this was possible. we have 2 contracts under agreement now with Fidelity. When did you put the other 1500 down?

I am still in rofr, but I emailed Rachel to see how to transfer the final funds, and ahe said up to an additional 1500 can be put on credit card. The remainder can be wire transfer or certified check. I prefer as much as possible on cc, so I can get the points.

I'm a little confused. Did they present the offer to the seller? Did they accept. Did you have a signed contract? There are so many things that could have happened that would have lost your contract even if they had your money in hand already. I'm not sure I can lay this at the feet of TSS. I'd encourage you to put in an ongoing request rather than watching the website. The best contracts are likely going to get snapped up prior to being listed. That'll also allow you to work out the deposit details ahead of time. And if you don't get one, or find one somewhere else, you can cancel without penalty.

I don't think TSS does on-going requests or at least they didn't for me. I ran a program to constantly scan their website and got a contract exactly like I wanted. It was exactly what I had talked to them about. I think I'm working with the same person as the OP and my transaction may end up failing because she was out of the office and not following up on my transaction.

They don't have to wait the 7 days. When there is a verbal offer and no signed offer by both parties, either one can back out.

It sounds like the OP never had anything more than a verbal acceptance--and, based on her last post, not even clear on that.

When I was selling a contract a few years ago, I agreed to a price with a buyer, sent my signed documents the next day. About 5 days later, I was informed the buyer had changed their mind and had decided not to sign the papers to go through with the sale.

We inquired about a listing with them back in early January and this VERY thing happened to us as well! We go the email saying to send in the deposit etc. and then I went to the website to check on the listing and saw it was sale pending. I emailed them asking about it and they said YES it was sale pending.....well then why did you send me an email with the required steps to put a deposit on it?

For this reason alone I will not use them. I went with Fedility and have a much more pleasant experience and am now in ROFR on my first DVC contract!

Either party has the option - under Florida law - to rescind within 10 days of either signing an agreement or placing a deposit...whichever is sooner. From what I get from OP's posts, neither of those events ever happened.

The selected pieces of this transaction offered by the OP are only one part of one-third of the story. We know nothing of the seller's side of the story, nor do we know anything about the broker's side of the story. There are far too few "facts" here to make any determination about what happened, or didn't happen...if anything.

Was the offer accepted? I was not countering any of their terms, so I presume that they would have accepted, as they accepted someone else's offer when TTS dropped the ball on my purchase.

Was there a deposit of any kind? I was told that I needed to send a check in the next 7 days... I was well within that timeframe when they sold the contract to someone else.

Well, I guess I am not the only one. And your happy outcome gives me real hope!

On-going requests would be great, but they obviously are not going to be as invested in finding the ideal contract for me as I am.

This is good to know. I would have loved to give the TTS rep my credit card info over the phone, and it is totally my fault for not pressing them on why this couldn't be done.

Am I going to storm TTS with pitchforks and torches? Nope, but I think that better communication is needed on their part. They sell hundreds of these contracts, I am guessing that a lot of their customers have never done this before. I think they should make things more clear. That is all I am saying!:)

Oh well, now I have to start over in my search, but I am expecting a happy outcome for me as well!!

There still has to be a formal offer, acceptance and money exchanged to formalize the deal. Many timeshare companies do non exclusive listings so it's possible that a given listing could be held by more than one company or even be listed in ebay as well as other sites. Or the seller could have changed their mind. It's also possible that the other offer could have been presented first, you may know this but we don't. I'm sorry it didn't work out for you but there will be other contracts.

Yes, all those things are true. And the rep would have known all that. I followed their instructions. I didn't insist on sending a check, that was the only option given to me.

I have been scouring ALL resale venues, it was not listed elsewhere.

There wasn't a prior pending offer, I made sure I was in first position, unless the rep was misleading me about that, as well.

I too am sure there will be other contracts, however, another one with every exact thing we wanted--probably not. But at least now I know how this is done and will give them my credit card number, even if they tell me the contract will be held for seven days pending the arrival of my check.

Chalk this up as a learning experience, but over the next few months there will be more contracts available from different listing brokers and you will find one you want. Be patient and when the next contract comes along, offer the price you want to pay regardless of the listing price. If that one falls through, pick yourself up, dust yourself off, and get back on that horse!

There are many sites it could have been listed. Some of the more common ones would be redweeks, TUG, bidshares, craigslist but there are many others including private sales. That appears to not be the case here. Regardless, you and the rep are on different pages, you may want to work with someone else which likely means a different company.
 
I think that if there was any kind of verbal agreement, if the contract was withdrawn or awarded to a different buyer, the rep. at least should have called the OP.

Thanks for sharing more of the details. I don't think it has to do with the deposit because as mentioned, until there is signed paperwork, anyone can back out.

To me, it sounds like you called, made a full offer, and that offer never made it into the paperwork stage because you have not mentioned receiving contract--which you would have, either that day or the next one at most, even before the deposit needed to be in.

We have dealt with TSS as buyers and sellers and both times, we were emailed the contracts within hours of the verbal agreement and it sounds like this may not have happened--which could be why the other agents didn't know you had made the offer.

Things happen and unfortunately, for you, it went the wrong way. Here is pixiedust: that a new contract, at an even better price, comes through!
